PINELLAS PARK, Fla. (AP) - Their options dwindling after two failed federal court appeals, Terri Schiavo's parents and brother vowed Wednesday to take their fight to the U.S. Supreme Court and state Legislature as the brain-damaged woman was in her fifth day without a feeding tube.
Gov. Jeb Bush renewed his call for the Legislature to step in and ``spare Terri's life.''
In a 2-1 ruling early Wednesday, a panel of the 11th Circuit Court of Appeals in Atlanta said the parents, who have battled with son-in-law Michael Schiavo for years over the woman's fate, ``failed to demonstrate a substantial case on the merits of any of their claims'' that the feeding tube should be reinserted immediately.
``There is no denying the absolute tragedy that has befallen Mrs. Schiavo,'' the ruling by Judges Ed Carnes and Frank M. Hull said. ``We all have our own family, our own loved ones, and our own children. However, we are called upon to make a collective, objective decision concerning a question of law.''

I disagree. There is an ongoing official investigation into abuse of Terri. The governor has the authority and the right to order her taken into protective custody while that investigation proceeds. Sure it would cause a constitutional crisis between him and the courts...but hello? that crisis already exists and it would shift the firestorm off of a defenselss, innocent woman who is being killed by merciless animals, and onto his broad shoulders where he has the means and hoepfully the will to fight it.
Just my thoughts.
He can? Wow! Well, if he's legally able to do so, as Chief Executive of the State of Florida, why hasn't he, then? Perhaps it's because he CAN'T? Maybe he doesn't actually have the power, within the law, to do so?
But hey, let's blame him anyway. Scapegoating politicians is fun. Especially our own...

I sure open adultery has been prosecuted in Florida before, even if not often. And even if arresting Michael for criminal adultery ultimately fails to save Terri, why not try it anyway? If you're going to arrest people who are just trying to take water to Terri, why won't you arrest the man who is killing her for his own violations of Florida law? Why does he get a free pass? Because adultery is popular but saving people from murder by starvation is not?
The one thing that puzzles me is why DCF can't take Terri into protective custody while they investigate the accusations of abuse and neglect.
It's unbelievable that an agency charged with protecting people from abuse and neglect has its hands tied while a subject is put to death by the alleged perpetrator.
Agreed. I support life, too, but these calls for the state and federal executive branches to break the law make me reeeeeeeeeal nervous...

As much as we disagree with it, Judge Greer's ruling is the law of the land until and unless it is overturned. Advocating unlawful and unconstitutional actions by Governor Bush or President Bush is not helpful; figuring out how to get the law changed quickly would be.

I'm curious as to how the Schindlers got their lawyers. They seem to do a very incomplete job of making their case. It's almost as if there is a conspiracy going on.
I think they feel they have no standing. Howedver< it seems to me that this denial of food and water is a direct violation of Terri's civil rights, and thus a Federal issue (cf. Rodney King).
Agreed. The agency has to get a court order to do so...guess from who? Greer. He's not going to do it.
That's why I say for the Governor to order it done as the Executive, who has equal constitutional standing with the Judge who is, in effect, using his judicial position to thwart the investigation, or render it meaningless by allowing Terri to die before it is complete.
There would be a constitutional crisis over it...but Terri would be fed and protected while it went on.
That's what I think should be done.

I don't think it's right but Michael Schiavo has a court order backing up his actions. The path you suggest in order to defeat him is convoluted, nonsensical and a sham.
That's what I cannot figure out and why wasn't the DCF asked to look into this a long time ago.
I am just guessing, but I would bet her family and their lawyers have not done a very good job of bringing all the facts out. She should have been put in protective custody a long time ago and why did the nurses wait so long to come forward with their affidavits? These affidavits should have been submitted to the Judge a long time ago -- he can only make a ruling based on the facts he has before him. Do we know what was submitted? And why wasn't action taken against her husband being the legal guardian the minute it was found out he was living with another woman and had children? Maybe it was but they needed a better lawyer IMO.
Then they can also have Michael arrested and let him defend his actions!!! Few people know that he is an Registered Nurse and knows exactly how to work the system to his total advantage!!!
Because it would accomplish about as much as pounding away on a keyboard demanding people "do something" which is exactly nothing.
