Ok, so the florida district court is a trial court and likely (and I am not a lawyer yet...and I won't be if I don't get my homework done by morning!) David Gibbs is filing a new claim in Terri's behalf just to get the tube reinserted until her appeal can go to the 11th. The 11th will review what has been going on, and hopefully they will see that constitutional rights were violated and then they would likely hand it back to the district court for a new trial...don't hold me to it, but that seems plausible.
