Was Gibbs' request filed in Atlanta? Wouldn't it have already been acted on by now? Also, is just one circuit judge in Atlanta needed to reinsert the tube, or is it a full-court vote?
Update From the Court:
From Cheryl Ford RN March 21, 2005 5:55 PM ET
No decision from the Judge. The Judge did not give any indication when he would issue a ruling. The court hearing lasted approximately two hours.
David Gibbs: Clearly stated his arguments surrounding the law and the basis of the Congress and the statement of the President of the United States. David argued how the US Congress, the President of the United States and the Vatican supported Terri's rights. Mr. Gibbs eloquently spelled out that this hearing today was not to discuss the entire case, but to have an emergency decision to reinsert Terri's feeding tube. Gibbs stated, "Patrick Henry said give me liberty or give me death. Gibbs argued that if she is dead, she has no liberty."
George Felos: Droned on for an hour essentially attempted to make every argument he has been making for the last several years. He then rudely stood on the street corner and spoke to reporters stating they would have to "slice Terri's stomach open" in order to put the tube back in. Felos tried to convey to the reporters how the "majority" of America agreed with him and that what Terri's supporters were attempting to sell was propaganda. Felos stated that the President and the Congress have overstepped their boundaries.
Felos again tried to play Doctor and discuss a procedure he knows nothing about. He also does not address how if he wasn't Hitler, her tube would still be in. He never had to have the tube removed, it could have been capped off.
George Felos in my opinion is an evil man who walks the same path of the men who callously marched people into the gas chambers.
Judge Whittemore seemed to listen carefully to the issues surrounding Terri's religious rights being violated and her legal due process not being followed.
Mary Schindler told me this afternoon, that this morning at 6:00 AM, Terri did laugh with her father. Mary is very frightened for her daughter right now. It has been 72 hours since Terri has had fluids and nutrition. The Schindlers are a loving family and wish only to take their daughter home to provide her with the same love they gave to her from the day she was born.
President Bush issued a statement earlier saying that this is a complex case and a serious issue, however it is wise to always look on the side of life.
We pray that Judge Whittemore will come to a decision soon and will realize that Terri's life is pending his decision.
You back from Hospice? Tell us more about this CD. What is it???????What is the importance of it? How is everyone doing at the Hospice? Any hopes this Judge MIGHT do something positive?
It will take acts of men to carry out God's will if indeed it is his will that she survive. Someone like Jeb or the President to stop this dehydration before it goes too far, even risking a shootout if the locals don't defer to a federal force, if one were sent. I am very weary of being told that I am foreclosing on God when I analyze the immediate situation. I am not. I take what is in front of me and respond to that. To assume I foreclose on God is incorrect. But from what I see, several of you are going to keep doing that and I cannot take that anymore. So no more for me. I will shutup.
And thank you for going and reporting.
I got to the courthouse right after the hearing ended. George Felos was giving a press conference. Felos gloated to the press that has won this case and that Terri's family will not win. Felos said that judge will side with him and not allow Terri's feeding tube to be removed. The judge indicated that he will take his time to decide if he wants Terri's feeding tube reinserted.
You can watch the press confernce by David Gibbs and Felos at this link http://www.tampabaylive.com/stories/2005/03/050321schiavo.shtml
Do you think when Gibbs was before this judge, he mentioned the horrible treatment of Terri all these years,
or did he just make the point about her civil rights being denied, such as against her religion, not having her own lawyer, and a 3rd point that I've forgotten.
That's what I read; and I looked at the Court website earlier, and looked up articles concerning that Judge. That Judge is JAMES Whittemore. If it went to another than Judge Whittemore, I do not know, but, as far as I am aware, the only Whittemore at the Federal Court in Tampa, is JAMES WHITTEMORE.
pls ask pc93 about the cdrom I presented to Hannity's Fox personnel.
He's probably heard that several hundred times in the past few days. He's not doing a damn thing.
Thanks. Are you coming to see Hannity live from Hospice tonight? If you do, DRESS WARM. It's raining and chilly already.
You will notice I withheld final judgement on the Bushes.
But the Judicial Oligarchy is highly motivated and cannot afford to lose this power struggle by acceding to Congress.
One of the Bushes is certainly going to have to act by force.
Those are lose-LOSE scenarios for the Judicial Oligarchy.
The Judicial Oligarchy can give in and lose some of their absolute power.
Or the Bushes can act at the last minute and crush judicial tyrrany on a range of things including WoT.
Having one Bush governor and one President is a strong pair.
Do the judges have the will to hold out? I say yes. Too much in the pot.
Do the Bushes have the will to act?
Can't tell. But I think the Judicial Oligarchy doesn't think so.
But if they're wrong they lose all, abortion, WoT rulings etc. because this Congress won't successfully impeach. There aren't enough RINOs in the Senate.
That is Bush's ace in the hole.
Is anyone tipping their hand?
Or Terri could die and it will all be moot.
Any poker players out there?
I think the Florida Legislature should quit dragging their feet and do their job....it is their job!
But there was a request filed by Gibbs for an emergency injunction and restraining order.
Good question. I am not sure where to get that info.
There's the rub. He's showing his spots. By his inaction, he's shown the world exactly what he is.
You need to understand something...faith in God is what it is all about and it can produce miracles...read your bible...
Well, they should have tried that approach this morning. But these are "Jim King Republicans," and I think they are fully in the Greer column. I don't think they can be persuaded.
I agree. And they passed the stupid law that made feeding tubes the same as ventilators. THEY are the idiots.
