True. Yes, there are times the Constitution is silent and/or not clear about many things so we do have to go beyond that and use our brains and good judgement to handle situations like theses. We cannot fall into the "android syndrome" where if it is "outside of the program" we default to some base code or say, "I am not programmed to respond in that area" much like the androids in the Star Trek episode with Harry Mudd. Even so, the preamble to the Constitution says basically we all have the rights to "life, liberty and the pursuit of happiness." Well, we know that Terri is being denied two of those right off the bat, "liberty" because she is at the mercy of her no good husband (IMHO, she is the victim of ultimate wife abuse, the feminazis should be screaming bloody murder, yet the silence is deafening) and "life," well, that's self explanitory and the main issue here. "Pursuit of happiness," well, some might hem and haw here but I have to say she is relatively happy. I know in her situation, she probably wishes to be whole but other than that, she seems ot be happy when her family is around spending time with her and so on so on the happiness meter, I say she is on the positive side. SO even if we have that take on the matter, she is being denied her constitutional rights right off the bat by using the preamble.
