Judge George Greer denied Terri's parents' Motion for a Stay to protect their daughter's life while there are still pending issues in this LIFE AND DEATH MATTER. In addition the Department of Children and Family Services made a surprise visit to the court hearing the other day and asked Judge Greer if they could approach the bench. Judge Greer denied DCF the opportunity to speak. DCF asked for 60 days to conduct a complete investigation of allegations that have surfaced in the form of a Complaint to their agency.
What was set in motion instead? On Friday, February 25th, Judge Greer REFUSED TO issue another Stay because he was "not comfortable" issuing a say to protect a Ward of the State but instead "set a date certain" (on his calendar at least, not on mine) to BEGIN THE BARBARIC, ANTI-AMERICAN, STARVATION-DEHYDRATION SLOW MURDER OF TERRI.
Attorney Gibbs for Terri's parents held a press conference after J. Greer's order that was so tastefully written to indicate that "he was giving the Schindlers until March 18th so they could "prepare for Last Rites." Attorneys Gibbs called this ruling and prior rulings "Hitler-resque". Indeed.
If Judge Greer wasn't LEGALIZING EUTHANASIA in his courtroom, why any need for Last Rites? Greer's urgency to fulfill this killing places urgency on every one of us to lobby Governor Bush, Florida's House and Florida's Senate.
A Judge in America is ordering the manner of someone's death, a disabled woman who is healthy but needs rehabilitation.
Time is short so we don't really have time to get into Greer's mind to see why he is Florida's Til of the Hun.

8. Tell your friends that Terri is alert and aware of her surroundings and to visit www.terrisfight.org to see her videos.
9. PETITIONS. We will gather current Petitions here for you. At this time, you can sign a SAVE TERRI PETITION AT www.renewamerica.us. THERE ARE ALSO IMPEACH GREER PETITIONS ABOUT.
Finally, the Pope has no Living Will. He will be SAFE as long as he stays away from George Greer's courtroom. The Pope is in our thoughts and prayers and he knows of Terri. He wants Terri to be freed from oppression and from a painless death by starvation-dehyration.

Wow, I wonder how they can do it - 3 weeks is a long time to spend away from home. Probably using up all of their vacation time for the year.

Re your question: "Would someone please explain WHY they think the latest version of HB701 will not be ignored by Greer? Seems to me he will latch onto the 'exceptions' clause, lines 165 thru 168, and say that Terri has already been 'found' to meet that exception, so he would say the new bill does NOT apply to her."
That section of the bill (line 165 thru 170) says the exception applies only when a person has "expressed directly" the withholding of food and water. Terri has never made a statement saying she wants food and water withheld...so the exception in this section wouldn't apply to her. If this bill passes, she would be safe.

Except that I read on a thread tonight (can't remember which one), someone posted that the Florida Supreme Court (that tried to give the Presidency to Algore), said that withholding food and water is not something that can be legislated, it's authority to do so is from the Florida Constitution. In other words, it doesn't matter what laws the legislators make, the Florida Kangeroo court will say it, the legislative branch, has no authority to prevent the withholding of food and water as pertains to Terri. How is it, though, that people would get in trouble for withholding food and water from inmates and animals?

Absent a further court order, Terri Schiavo's feeding tube will be removed on Friday, and she will starve -- painfully, many say -- to death. Doesn't it strike you as eerie that the court relied on the testimony of an "estranged" husband in making its decision?
Doesn't it strike you as horrifying that Terri may very well want to live but they are going to cause her to die, not by removing a respirator, but a feeding tube?
Do you really believe that Terri's husband, Michael, who is living with another woman with whom he sired two children, is refusing to relinquish guardianship of Terri to her parents because he is irreversibly committed to carrying out Terri's wishes?
Do you believe that disabled, but conscious and self-breathing people who can't physically feed themselves or verbally express their desire to live, but who have left no written legal directions as to their destiny in such circumstances, should be starved to death?
How likely is it that Terri, now only 41 years old, would have discussed her wishes as to life support with her husband in 1990, when she would have only been in her mid-twenties and with no inkling of life-threatening or disabling medical conditions?
Without question, even young people discuss these unpleasant matters when they go through the process of estate planning. But Terri didn't even have a will, much less a "living will" or health care power of attorney. If Terri had been so strong willed and adamant on the subject, why didn't she make sure to get her papers in order?
Even if Terri did tell her husband she wouldn't want to be kept alive "artificially" in the event of her incapacitation, is it likely she would have been so explicit as to cover all possible scenarios (like she might have in a lawyer's office), such as those in this case? If you actually believe she did express her wishes to Michael, do you think she was so thorough and unambiguous as to make clear her irrevocable desire to die even if it meant starving to death when she could breathe on her own?
What is the urgency, other than financial, to end Terri's life, especially when her parents have expressed a desire that she be kept alive and have agreed to care for and assume guardianship over her? Do you really believe that Terri's parents would insist on keeping her alive if they believed she were miserable and didn't want to go on living?
Were you aware that some believe that suspicious circumstances surround Terri's injuries and that discrepancies exist concerning her medical condition, such as whether she suffered a heart attack?
Did you know that not long ago the Florida Department of Children and Families sought the court's permission to intervene in Terri's case for the purpose of requesting a delay to give it time to investigate abuse allegations?
From what I've read, while Terri is severely disabled, she's not in a so-called vegetative state, she's not in a coma, and she's not medically terminal -- except by court decree of starvation. What if, as Terri's parents believe, Terri truly does want to go on living but just can't verbally express it? Would it be ethical in that event to starve her just because she can't feed herself?
If not, then on what basis has the system decided to terminate her life? Surely we can agree that it's entirely possible that Terri does want to live even in her current condition and even if she expressed a general desire 15 years ago that she would not want "heroic measures" performed to save her in certain circumstances.
Given Terri's reported responsiveness, her ability to breathe on her own, and the doubt and suspicious circumstances surrounding this case, shouldn't the question be resolved in favor of life, especially given what we've seen recently, for example, with the comatose patient regaining consciousness after 19 years?
I find it haunting that we live in a culture of death where the presumption seems to be against finding that a human being would want to go on living and the burden of proof is on those promoting life.
Terri Schiavo and her parents need and deserve our prayers.

So what shall become of Michael's "bird"-- Will he starve her as he intends? Or will she be rescued by those far and wide who'd be honored to be called her friends? The future right now is hard to see though a showdown is coming nigh. Well the forces of life trump the judge who says, "The law of the case is that she must die?" |
First of all, if the legislation is not passed before the feeding tube is pulled, Felos will do everything he can to delay its reinsertion. Even if the legislation is passed first, Felos will probably pull the tube and try to declare it a fait accompli.
What I would expect will happen, even if the Schindlers win the first wound, will be that Felos will immediately seek a ruling from Judge Greer that Terri's alleged statements meet the new evidentiary standard. Never mind that they obviously don't. No matter what evidentiary standard is required, Greer will declare it met. Even if a written statement was required, Greer would accept testimony from a graphologist who declared that some scribblings on a cocktail napkin were authentic writings by Terri, even if a forensic handwriting expert declared that they were in Michael's handwriting. An appeals court wouldn't actually see the supposed documents--all they'd see would be conflicting witnesses, and they'd accept the trial court judge's determination of which witnesses were credible.
So the next step will be either (1) DCF investigates enough to prove malfeasance in Terri's care, or (2) Greer gets impeached. Of course, the former might cause the latter. From what I understand, Florida requires a 2/3 house vote for impeachment (unlike the U.S. government which only requires a majority). That would be a tough hurdle to beat, though perhaps not insurmountable. It'll certainly not be an easy fight. On the other hand, impeachment immediately suspends an official's power, unlike the U.S. where officials keep power until the Senate votes them out of office.
I think if Terri's case can ever be heard by an honest trial court judge, she'll be pretty safe. If Greer were impeached, a new judge would almost certainly feel free to ignore any and all of Greer's earlier findings of fact, and I don't think a new judge would want to dirty himself by siding with the Devil. Such a move may have been rational when nobody was looking at the case, but with everyone watching it's just plain dumb.
So what happens next? I have no idea.

Clearly, state Circuit Courts are not applying the law appropriately in a number of cases throughout the United States as it relates to vulnerable and incapacitated persons and their retained rights. A measure like bill 1151 would give these innocent people a Federal avenue of review that we consider a retained right of criminals. I believe the rights of the disabled amongst us should be no less vigorously defended than the rights of those who have broken the law.
I also believe that without such Federal protection, cases such as these will grow more complicated and burdensome on the state courts and innocent lives will be lost.
Please do the right thing for America's disabled and give your unwavering favorable consideration to this act.
