I think if malicious intent can be proved, then the boundary is crossed.
That's why courts look at each case and determine if a person had that malicious intent in mind when he/she published/spoke those ideas.
If you just quote Bible in some sort of pastoral setting it is one thing. If you are quoting Bible at the meeting of organization known for its gay bashing activities, that is something else.

If marxist passages are read at a Christian bashing organizational meeting, are they guilty of a hate crime? Who dares to publicly accuse their org and lit of anything wrong?
I totally buy the malicious intent test. If the law were applied equally, the outcry for repeal would be deafening from the millions being jailed.
