Man who shot home intruder indicted for second-degree murder

NEW BEDFORD, Mass. -- A man who shot and killed another man on his property has been indicted for second-degree murder, according to prosecutors. The grand jury indicted Charles D. Chieppa, 56, for the July 17 shooting of 26-year-old Frank Pereira Jr. with a rifle.

The fatal shots were fired near Chieppa's property just before dawn. By sunrise, motorists drove past Mr. Pereira's body, honking their horns and shouting in support of the shooting, the Standard-Times of New Bedford reported.

Chieppa, a Vietnam War combat veteran, lived in his parent's old home and largely kept to himself, neighbors said.

The home was next to Alfie's bar, which is known for drug dealing and prostitution. Pereira had snatched a purse from an Alfie's patron just hours before he was shot, police said.

Police had initially said the shooting happened when Chieppa confronted a burglar breaking into his home around 4 a.m. A day later, detectives acknowledged that they were investigating whether Pereira had actually entered the house before Chieppa opened fire.

"My son didn't deserve to die the way he did, even if he was trying to break in," said Evelina Salgueiro, the victim's mother. "You don't shoot someone in the back like that. He was shot in the street."

2. You CANNOT plug someone over property...EVER! Call 9-11 and then call your insurance company.

WRONG. It depends on the state. In the northeastern totalitarian police states like NJ, NY, MD, and MA you are not allowed to defend yourself or your property. In those less totalitarian parts of the country such as Texas and Ga you can.

it's massachusetts, what do you expect.

I visited my sister there yesterday. I got a speeding ticket (a set-up right past a sign where the speed limit is arbitrarily cut nearly in half).

Then on the way out (got lost in boston, of course), I see the most enormous billboard I have ever seen with some message about how "gun laws work." I couldn't wait to get away from that God forsaken socialist pit.

From the comments I see here on Texas law, this would be no-billed there.

You are correct.

I've seen that billboard several times. Really gives you an appreciation of what sort of jerks constitute the majority of massholes

lol, but, I'm not sure it's the majority. My rule of thumb is, the greater the PR effort, the smaller the actual support base is. Smoke and Mirrors, my friend.

The figure quoted in my last Concealed Carry class was $10,000. as the minimum one can expect to have to spend in their defense if you kill someone trying to steal your property.

I have two cop friends here in TX. They both told me to do and say EXACTLY what you just stated. Almost verbatim.

That's my impression of Texas law too. I lived there for decades.

There was an auto repo person killed by shotgun while trying to tow a car away. Apparently the repo person didn't want the police to accompany him as the city of Houston gets 25.00 for their time when doing this.

Looked like theft to the owner, who had some trouble with kids trying to steal his car earlier in the week.

Teddy Kennedy, John Kerry, Barney Frank - I rest my case that it's the majority of the voters anyway.

Technically, you're right. But not the will of the people, for sure. It never is.

Good saying -- never heard it before.

"couldn't wait to get away from that God forsaken socialist pit."

I had to work there for two years and covered eastern Massachusetts. They tell you not to burn your bridges, but strangely my favorite bar the Rocking Horse in Norton burned down a week after I left to go back to Texas.

If you SHOOT someone, here is what you MUST SAY to the cops:

1. I WAS SCARED FOR MY LIFE. I was OHHHHH so SCARED!
2. HE/THEY/SHE said that they were going to M*****F*****ING KILL me. 3. I WILL NOT SAY ANOTHER WORD UNTIL I SPEAK TO A LAWYER!

Actually, IMHO and also as a NRA certified Personal Protection In The Home instructor, #3 should be the first. Then do it - shut up, no matter how difficult it is.

and let me be clear....I do not advocate "plugging" someone for criminal mischief...

You personally may not, but the celebratory tone of the posts talking of the Texas law sure does.

That "law" is pure evil, BTW - there is no moral right to take someone's life for trespassing.

probably wouldn't hurt to say the guy was calling you a "faggot," either.

Highly likey...but not guaranteed....you still get the pleasure of spending your life savings on an attorney...but the good news is no jail. Uh...did I mention this defense does not make one immune to civil prosecution?

Yes, he was a good boy! You should be proud of the man you raised!

My posts are clear to the intelligent among us..... You are obviously making an assumption.... Law abiding Texans do not use deadly force against trespassers....hell..we throw rattle snakes on em'.... Where did you get that shootin idea? You must be from NYC....
