Jurors face difficult decision over Scott Peterson's fate

SAN FRANCISCO (AP) — If the experience of those involved in past death penalty cases is any guide, the jurors in Scott Peterson's murder trial will have to grapple with raw and deep religious, moral and legal issues as they decide whether he lives or dies.

Arguments in the penalty phase are scheduled to begin Tuesday, but experts say many of the jurors may already have made up their minds about what punishment the 32-year-old former fertilizer salesman deserves.

In 2001, a California jury faced a case that holds some similarities to the Peterson trial. Todd Garton was a philandering husband convicted of the shocking murder of his young and very pregnant wife. Jurors said he deserved to die.

"I signed the document that the jury found for death and I think about that a lot," said Fred Castagna, who served as jury foreman. "It was emotional during deliberations, but I don't lose sleep over it."

I agree; it's kind of frightening.

My thinking is that if he was innocent, he'd get on that stand and beg for his life.

An egotistical imbecile. He thought he had it all figured out and he would never get caught. Not only was that wrong, but now he is precluded from begging for his life because to do so sucessfully he would have to destroy his chances for a sucessful appeal.

He is precisely where he belongs, between a rock and a hard spot, with HIS life in the balance. I hope he suffers a breakdown. Hell on earth before hell in hell.

Don't know what's going on except they've been in chambers all day.

I hear Geragos is wearing tap shoes...

IMO Geragos will do ANYTHING to rescue his reputation including "setting up" one of the jurors!!

Do you think he's capable of having a breakdown? I'm not sure; he strikes me as just about as cold as anybody I've ever seen.

I agree with you about Peterson; I don't think he has a conscience at all.

He's as cold as they get, but that won't necessarily keep him from breaking down.

Do you think he's capable of having a breakdown?

He won't break down from guilt, but he might break down from being separated from everything he values and the knowledge that he will NEVER get near it again. No hope.

Funny thing is, that anytime Geragos tries to rescue his reputation, he digs himself deeper in the hole.

Hoping this is one of those times.

Any word on Dev?

A guy called into a local radio show who said he had been in "the joint". He said that Scottie-boy wouldn't make it a year -- the inmates would take care of him -- they especially don't like wife/baby killers. Said that he could be under guard 24/7, but they would still get to him. Maybe life in prison will take care of him -- we'll see.

Moving right along; I guess it wasn't a big deal, huh? Again.

None of the jury looked at Scottie!

You're right; he would breakdown for HIMSELF, but nobody else.

Sheesh, with all the predictions of BIG TROUBLE brewing by the CTV panel, which does nothing but rattles nerves, the hearing is finally underway BUT will probably break for lunch within minutes.

BTW CTV is continuously losing live feed. Is it only at my end?

This is NOT justice. No way.

It sets a dangerous precedent whereby police and prosecutors can accuse anyone of anything and get a conviction.

By this standard of evidence we can convict and execute *witches*.

PIFFLE!

"Go find a link of his phone call New Year's Eve when he claimed to his girlfriend he was watching the fireworks at the Eiffel Tower. He was actually at a prayer vigil for his 'missing' wife."

OH! I didn't know that! That sures "proves" his guilt!

I repeat, there was absolutely NO physical evidence. Phone calls are not physical evidence. Of course I could tell someone on the phone all day long that I was the mystery person on the grassy knoll in Dallas in Nov 63. That does not make it so nor is it physical evidence. I have no idea how any thinking person could find him guilty with the lack of physical evidence.
