NAZARETH, November 15, 2004 (LifeSiteNews.com) - The Nazareth District Court ruled 2-1 yesterday that Israel is required to recognize inheritance rights between homosexual couples. The court ruled that since the inheritance law makes an allowance for non-married common-law couples to have inheritance rights, homosexual couples must also be allowed those rights.
The clause in the inheritance law states, "a man and a woman who live a family life in a joint household, yet who are not married to each other," are to be granted the same inheritance rights as married couples. While the state argued that "man and woman" could not be interpreted to mean homosexual partners, Judges Nissim Maman and Gabriella (De Leo) Levy ruled that since that clause was initiated in 1965, "there have been wide-reaching changes in interpretation, and legal rulings have widened the meaning of the term `partners' to include common-law partners, as well as same-sex common-law partners."
Thus the judges said the phrase "man and woman" does not mean "not a man and a man" or "not a woman and a woman," but rather "a couple who is not married."
Judge Menahem Ben-David dissented. "The letter of the law is clear and unequivocal and you cannot read into it any meaning other than what is written - `man and woman.' The letter of the law cannot tolerate the interpretation according to which this would be `man and man'," he wrote.
Ayin Mem applied to the courts to inherit his homosexual partner's estate since no provision was made in his partner's will.
Yes I agree that homosexuality is evil. But it is not illegal.
Yes, I agree in the context of inheritance rights and legal documents. Without a will this persons possessions go to probate which is precisely where it would have been if he had been legally married.
Spouses and Civil Unions. Not everyone believes in legal marriage. There are many people who choose to survive without the benefit of marriage. I just dont see what harm there is in recognizing this persons domestic partner.
I wholeheartedly object to Gay Marriage because marriage is a religious institution and should stay there. At the same time I wholeheartedly object to denial of domestic partner benefits for those people who are legitimately partnered.
So in this case since there was no will and testament, the inheritance will likely be questioned in probate court. Not because the relationship was illigitimate, but because there was no Last Will and Testament.
It's not a religious issue once it arrives at the courts. So I dont see a reason why it is a problem if this person happens to be a bone smoking saddamite.

None other. This idiot flatters himself by thinking his party gained so many votes in the last election because they agree with his platform, which contains one plank: Destroy religion!
Because of Israel's F*@ked up electoral system, with multiple parties, Shinui gained votes from dissatisfied Labor party members who were disgusted with Barak and Peres, but yet couldn't bring themselves to vote for Likud.
Meanwhile, Shas and the other religious parties lost votes to Likud from Orthodox Jews who thought it was more important to defend the country than their own personal agendas.
If he is so enamored of secularism, then why doesn't he just move to France; a country that is so militant in this regard that young men can't even wear their kippahs in the streets without fear of being attacked?
