Mom Sent To Jail For Smoking Around Kids

POSTED: 6:43 am EDT August 13, 2004

BOWLING GREEN, Va. -- A woman was sentenced Thursday to 10 days in jail for defying a court order not to smoke around her children.

Tamara Silvius was banned last year from smoking around the youths, now ages 8 and 10, as part of a custody arrangement with her ex-husband.

If the "government" wants to make smoking illegal then mayby the "government" should quit subsidizing tobacco farmers.And doubling the taxes on tobacco products.( I'm not a smoker)

If I agree to pay you $50 to mow my lawn (no disrespect intended), you mow it, and I fail to pay: you take me to court. The cops don't come and arrest me. If she agrees to not smoke with the kids, and she renegs, the ex-husband should take her to court and have the custody arrangment changed.

The difference is that she made an agreement in court whereby she knew that smoking around the kids would result in her arrest. This was also the second time that she violated the order.

Having said that, I think that the order is absurd. I thought that the entire "second hand smoke" scare was shown to be nonsense some time ago. Nevertheless, she knew the rules, she broke them, and she got her medicine.

Let us know how the pool incident turns out.

It's more about people trying to control other people's bahviour than it is about health.The health issue is a crock as far as I'm concerned.

My attitude is not the problem, I believe in rules and following them. People cannot just do what they want to do, although the democrats think they can do drugs, smear peoples names and just ignore the Constitution. Evidently you believe that too.

Excuse me! How in the world this you come up with that nonsense, of course not!! I do believe that we are NOT to be rebellious morons, it hurts our party and our cause. It isn't good example for children to follow by disobeying a ruling specifically to protect the children, so be a democrat if you want to...but the republicans I know follow the rules as long as they are appropriate..in this case it was appropriate demand.

I believe President Bush would agree with me on this one, don't you??

OH and I wouldn't want you by my side either when orders are given, you are kind of person that would get someone killed while you are being the maverick know it all.

No, this is a guy who has issues with the court system and the fact that his constitutional rights have been stripped from him. I am in a wonderful second marriage. My wife understands the issues.

You two are right out of the NOW playbook. Femi-Nazis are plentiful in this country. Why you're here on FR is a mystery to me. Do a little research. The percentage of divorces initiated by women. The child support awards. The lack of due process in divorce/custody hearings. Indentured servitude for men paying support. You call yourselves conservatives? You don't know the meaning of the word. You condone adultery and no-fault divorce. You condone broken homes. Women like you are the reason we have the problems we have with kids in this nation.

If you were honest, you would realize the ex-husband in this scenario is an angry guy who is trying to stick to his ex-wife.

I have seen ex-wives who try to stick it their husbands, leaving them with nothing and have stood up for the husbands.

I have seen husbands walk away from their families, and boyfriends refuse to marry or pay child support to the mothers of their children(otherwise known as deadbeat dads) and get away with it.

It works both ways.

And sometimes the spouses are equally at fault.

I at least try to be honest and call each situation for what it is.

In this scenario, if a wife had done this to her husband, I would have stood up for he husband.

In your first reply, you immediately found fault with her.I found fault with the courts. You allowed your bad experience to color your judgment producing a prejudicial result.

I am aware of two men I have known since childhood who have gotten divorced recently. In both cases, I blame the wife. In the one case, I predicted it would end in divorce,(and this is before they had children and boy did I pray they didn't have children) because she was an immature self-centered narcissist. Ten years later with two beautiful little girls, she decides to end the marriage. Sure wish I had been on hand before he married her, but he probably wouldn't have listened.

I attempt to be fair in my judgments about these things and have treated the men in my life well, so don't you dare attempt to paint me with THOSE label. Many people have been mistreated by the opposite sex, but they still endeavor to be fair. I consider myself one of those people.

Wait 'till I tell my friends you called me a feminazi. They will laugh their heads off. I am the most traditional among them, and have been advocating all my adult life that mothers who can, stay home and raise their children because their children are far more important than any career. Also, I am not generally in favor of divorcve, particularly for couples with children.

You sound much like the blacks who were happy that OJ got off. As one black friend of mine said spontaneously at the moment of the announcement of OJ's acquittal, "That's for all the trouble we've taken from you white folks all these years." Me thinks your reaction to the dilemma of the woman in this article, was mighty similar to my black friends reaction to the OJ acquittal. It was neither rational or fair.
