Police: Hacking Said He Killed His Wife
Associated Press ^ | August 3, 2004 | staff

Posted on 08/03/2004 2:27:33 PM PDT by johnfrink

The husband of a missing pregnant woman told a "reliable citizen witness" in the psychiatric ward that he killed his wife as she slept before throwing her body in a trash bin, according to a court filing.

The statement, released Tuesday by the Salt Lake County Sheriff's Department, also says investigators found human blood on a knife in the bedroom of Mark Hacking's apartment and on their bed's headboard and a bedrail.

Blood found in the bedroom matched traces of blood found in Lori Hacking's car, according to the statement.

Mark Hacking was arrested Monday on a charge of aggravated murder, two weeks after he said his wife failed to return from a morning jog. He has not been formally charged and is being held without bail.

Premeditation doesn't make it capital murder?

Greta just showed an "exclusive" video of Lori and Mark going into the convenience store earlier that evening.

THEN, she showed the one where Mark came back alone, around 1:30 am. It appeared he had on the same clothes.

Now, if he killed her before he went to get his smokes, there HAD to be blood on that shirt?

At the Desert Morning News last night/today, was an article reporting that a friend of Lori's said she never jogged alone and that it would be quite unusual for her to jog at 5 AM.

Premeditation doesn't make it capital murder?

No. Premeditation will make it murder. For a death penalty case, you have to have an aggrivating factor such as the status of the victim (cop, judge, etc) or status of the killer (prior conviction for certain listed felonies) or place (in prison, part of a hijacking, etc) or purpose (in prison, fleeing from justice) or motive (murder for hire, prevent a witness from testifying) or method (weapon of mass destruction, poisoning) (list not exhaustive - consult the statute for more)

The only one that could possibly be used here would be multiple victims, the evidence is not presently available for that.

Death penalty cases are so much more expensive, and have so many traps for the prosecutor, that most DAs won't try for one unless they have a solid case.

I'd venture to say most Mormons believe in the death penalty. Some in liberal Salt Lake might not, but the LDS Church does NOT have a problem with it (thus, Utah has always had a death penalty).

So, in the case of the two families, they might not want the death penalty due to their personal beliefs, but not religious ones.

I guess. Who will I be then?

I see no way Mark Hacking could be considered insane even with the nude walking episode. IMO, it's laughable considering the video tape. He's toast.

In this case, I don't think so, snoper. In Utah, mental illness is specifically ruled out as an affirmative defense against a charge of aggravated murder.

Utah Criminal Code 76-5-202.

"It doesn't sound like a death penalty case."

See (1)(b) and (p) at Utah 76-5-202. If she was pregnant, it wouldn't matter whether he knew that or not. It would still be multiple murder under (b). Moreover, cutting a woman up in her bed and tossing her in a dumpster constitutes a heinous crime (p).

Thanks for the clarification and the link. Correct me if I'm wrong, but didn't it used to be much easier to fry someone for murder?

I'm sure Scott Peterson is thinking, "what an amateur".

I know I shouldn't, but....hehehehehehe!

In Utah? I don't think so. The police have their ducks all lined up in a row. Mark Hacking didn't cover his tracks at all.

Just out of curiousity, how many "reliable citizen witness" does one run across in a Psychiatric ward anyway?

I just finished watching the local news. They reported that he confessed to a reliable witness and seemed to think that it was a member of the Hacking family.

By reason of temporary insanity.

Not in Utah. Utah has the most restrictive laws for insanity pleas in the nation. It can be a mitigating factor. Utah puts them away in a mental institution until they get better, and then puts them in prison to serve their time for the crime.

If she was pregnant,

You aren't going to be able to prove that wiyhout an autopsy, and given the heat there, even that gets "iffier" as time passes.

Moreover, cutting a woman up in her bed and tossing her in a dumpster constitutes a heinous crime

I don't know if the evidence is there to support that. Don't forget this requirement, " before death."

Was there ever much doubt?
I blame this partly on the media's new fixation on these kinds of crimes. They make those who are already deranged think they will become famous by doing this, and in the case of Peterson, get a high profile attorney and get away with it. That is just my opinion, but I do think there is some truth to it.

This nutjob even used almost the same story as Peterson, which also harkens back to Chandra supposedly going jogging and never returning.

I've heard speculation that both families may request that the DA not seek the death penalty due to their religious beliefs. The DA could ignore the request, but I doubt it's a good career move to piss off the Mormons if you work for Salt Lake City.

Where did you get that information? I'd say on the average, more Utahns are in favor of the death penalty than not. And our beliefs are more in favor of the death penalty.

The one thing that has bothered me from Day 1 was, what kind of man sat idly by while his wife jogged ALONE in the early a.m.???????

Apparently that was one more of Mark Hacking's lies. Lori Hacking's brother said she never went jogging alone, she had a running buddy.

I just saw the videotape on the local news station. They said that Mark Hacking had changed his pants and shoes when he came into the convenience store the 2nd time Sunday evening.

Maybe he will opt for the firing squad execution, like in the book, Shot through the Heart, so he can spill his blood on the ground and gain redemption.

The plice say they know the motive for the killing, and that is why Hacking was arrested for aggravated murder. However they hadn't talked to the DA's office, so...
