The husband of a missing pregnant woman told a "reliable citizen witness" in the psychiatric ward that he killed his wife as she slept before throwing her body in a trash bin, according to a court filing.
The statement, released Tuesday by the Salt Lake County Sheriff's Department, also says investigators found human blood on a knife in the bedroom of Mark Hacking's apartment and on their bed's headboard and a bedrail.
Blood found in the bedroom matched traces of blood found in Lori Hacking's car, according to the statement.
Mark Hacking was arrested Monday on a charge of aggravated murder, two weeks after he said his wife failed to return from a morning jog. He has not been formally charged and is being held without bail.

No. Premeditation will make it murder. For a death penalty case, you have to have an aggrivating factor such as the status of the victim (cop, judge, etc) or status of the killer (prior conviction for certain listed felonies) or place (in prison, part of a hijacking, etc) or purpose (in prison, fleeing from justice) or motive (murder for hire, prevent a witness from testifying) or method (weapon of mass destruction, poisoning) (list not exhaustive - consult the statute for more)
The only one that could possibly be used here would be multiple victims, the evidence is not presently available for that.
Death penalty cases are so much more expensive, and have so many traps for the prosecutor, that most DAs won't try for one unless they have a solid case.

I'd venture to say most Mormons believe in the death penalty. Some in liberal Salt Lake might not, but the LDS Church does NOT have a problem with it (thus, Utah has always had a death penalty).
So, in the case of the two families, they might not want the death penalty due to their personal beliefs, but not religious ones.

I see no way Mark Hacking could be considered insane even with the nude walking episode. IMO, it's laughable considering the video tape. He's toast.

See (1)(b) and (p) at Utah 76-5-202. If she was pregnant, it wouldn't matter whether he knew that or not. It would still be multiple murder under (b). Moreover, cutting a woman up in her bed and tossing her in a dumpster constitutes a heinous crime (p).

In Utah? I don't think so. The police have their ducks all lined up in a row. Mark Hacking didn't cover his tracks at all.
I just finished watching the local news. They reported that he confessed to a reliable witness and seemed to think that it was a member of the Hacking family.
Not in Utah. Utah has the most restrictive laws for insanity pleas in the nation. It can be a mitigating factor. Utah puts them away in a mental institution until they get better, and then puts them in prison to serve their time for the crime.
You aren't going to be able to prove that wiyhout an autopsy, and given the heat there, even that gets "iffier" as time passes.

Where did you get that information? I'd say on the average, more Utahns are in favor of the death penalty than not. And our beliefs are more in favor of the death penalty.
Apparently that was one more of Mark Hacking's lies. Lori Hacking's brother said she never went jogging alone, she had a running buddy.
I just saw the videotape on the local news station. They said that Mark Hacking had changed his pants and shoes when he came into the convenience store the 2nd time Sunday evening.
Maybe he will opt for the firing squad execution, like in the book, Shot through the Heart, so he can spill his blood on the ground and gain redemption.
The plice say they know the motive for the killing, and that is why Hacking was arrested for aggravated murder. However they hadn't talked to the DA's office, so...
