DENVER (Reuters) - Crime laboratory evidence shows the 19-year-old woman who has accused Kobe Bryant of rape had consensual sex with another man hours after she said the basketball star raped her, MSNBC reported on Wednesday.
The DNA evidence from the prosecution's own laboratory could be introduced in court as early as Thursday when the Los Angeles Laker will be back in an Eagle, Colorado, courtroom for a pre-trial hearing, the cable TV report said.
Bryant's lawyer, Pamela Mackey, laid a bombshell in a prior pre-trial hearing when she suggested the woman had sex within 15 hours after she said she was raped.
Through her attorney, the young woman denied having sex so soon after she said she was raped on June 30 at a Colorado resort where she worked and Bryant was staying for out-patient surgery on his knee.
According to the MSNBC report, fresh sperm and semen samples were found inside the woman's body from samples given during a rape examination and that such evidence would prove she had sex within hours after the incident with Bryant.

How the Hell can you prove a negative. If that were true I could accuse you of anything. Say for instance making terrorist threats to me, and of course you could NEVER prove a negative (that you didn't do it).
I am at work, but from what I have heard:
Judge is fed up with the prosecutions delays, embarrasses them in open court.
Prosecution fails to respond to motions on time.
Judge scolded prosecution because they are making it hard for him to set a trail date because they are so unprepared with dates for scientific testing.

State District Judge Terry Ruckriegle issued a rare bench ruling Thursday authorizing the review.
Bryant's defense team alleges that his accuser sent a text message to her ex-boyfriend shortly after her encounter with Bryant.
An attorney for the ex-boyfriend was in court Thursday arguing that allowing the defense access to the phone records would be an invasion of the ex-boyfriend's privacy.
The defense will be allowed to examine the phone records behind closed doors.
Also at the hearing, Bryant's defense team was expected to attack the police work that led to a sexual assault charge against the NBA star.
Prosecutors are fighting the defense bid to call a veteran detective to testify. John Ragle in 1995 criticized the crime-scene investigation in the O.J. Simpson slayings case.
Ruckriegle scheduled open-court arguments on that topic and several others, including a defense request to obtain genetic profiles from unidentified sources.
Although Ruckriegle was expected to set a trial date Thursday, he said that he was unable to do so until some pending issues had been resolved. He chastized the prosecution for missing key deadlines regarding DNA testing.
Following the hearing, Bryant was expected to fly to Los Angeles for an NBA playoff game against Minnesota. It would be the fifth time he has played in a game the night after appearing in court.
Bryant, 25, has said he had consensual sex with a 19-year-old employee of the Vail-area resort where he stayed last summer. If convicted of felony sexual assault, he faces four years to life in prison or 20 years to life on probation and up to $750,000 in fines.

No, he won't be convicted of rape. Like I said, his story against hers. Who knows the truth? But the aggravation he is going through is his own making. Remember the right =wing conspiracy? Poor Bill was set up. Yes, Kobe made a mistake - a huge one and while he won't be found guilty he is paying a price.
this is just like the teen rape trial in Orange County....the girl was sleeping with the two defendents and commenting into the video camera that she was now a porn star days before the assault.

I think you're right about that; I'm almost positive that he tried to hide this evidence behind the Rape Shield Laws.
Plus, there are a lot of questions about just HOW the accuer's rehab bills were paid; the Colorado Victim fund specifically says $20,000 per victim and her rehab cost $35,000 a month.
Additionally, why did Hulbert request those phone records? Evidently she text messaged a LOT of people on the way home from the hotel!
Even trashy women get raped. Doesn't mean they deserve it. Even murderers can get off if they are rich and can pay for the right attorney and can trash the victum.
Do you belive that Broderick women was raped by Clinton? Maybe she was, maybe she wasn't. No one knows for sure. It can never be known for certain. Rape cases are difficult to prove because there are usually only 2 people there;
Many women are raped everyday but don't report it because they cannot prove it.
I don't care how many people she had sex with before and after, it doesn't mean she wasn't raped by Kobe Bryant.
It certainly doesn't mean the prosecutor framed Kobe. It could mean the proseceutor was inept like Marsha Clark, however.
My point again, is this case can never be proved either way. Kobe will walk but his reputation is shot and so is the young woman.

It's still just being asserted--in its weird way--by the defense. And predictably enough, the court day came and went and the story changed.
When one is not dealing in facts, but spin (see democrat-style strategy which I can spot a mile away), that is just the way it goes.
