Persistent and Loyal Friends of Terri and of the U.S. Constitution,

I'm home from today's hearing which was held at the Criminal Courthouse Complex on 49th Street, Clearwater before Judge W. Douglas Baird.

Once I collect my thoughts from today's hearing which just adjourned about a half an hour ago, I'll post them here. Initially, I wasn't going to do any reporting re: the hearing but it was enlightening.

I learned today in the hallway that Terri's parents, siblings and other relatives are still unable to see her some three weeks later due to the criminal investigation of what may have been mosquito bites. But, that's a different legal matter.

Man Charged In Disabled Woman's Rape Freed

76-Year-Old Suffers From Dementia, Memory Loss

ORLANDO, Fla. -- A judge ruled that an elderly man charged with raping and impregnating a mentally disabled woman will not face prosecution or be committed to a mental facility because he suffers from a degenerative disease.

Orange Circuit Judge C. Alan Lawson also ruled Monday that 76-year-old Phillip Strong, who suffers from dementia and memory loss, cannot have unsupervised contact with any mentally disabled person or child and must be evaluated in a year.

Strong was accused of raping a woman, known only as J.D.S, at a group home formerly run by his wife, Hester.

Hester Strong has been charged with felony negligence and is awaiting trial.

J.D.S. now lives in another state-licensed facility. Her baby lives with foster parents.

Most of us could point out a few sickening similarities and maybe some significant DIFFERENCES to Terri.

My favorite is hilighted. Its such a shame Greer/Baird/Demmers are all so corrupt they can even pretend not to notice several felonies (including felony negligence) in progress.

Relative to our status as mere activists in Terri's behalf, please take it upon yourself, as a member of the inner-loop, to address the list of 'violations' provided by pc93 in Post 90 to Terri's legal team, and learn if the 'violations' already been weighed by the court? If so, how did the court decide?

It would be very helpful for FReepers to develop a list of laws the courts of Florida have refused to recognize to show a history of capricious and unlawful bias the courts have toward Terri. I'm confident Ms. Anderson's volunteers could perform this task is short order.

Further, if the laws in question have not been addressed, the obvious question is to the pro bono knights is:

Thanks for that link, pc93. I have forwarded that link to my family remaining in Florida with a heartfelt plea to contact the agencies listed there, so that hopefully Terri can get more help from her fellow citizens. I asked them to forward it to their friends and neighbors, too. I am hoping that in conjunction with the united prayers of Terri's supporters, we will make way for Terri's release from her prison.

I have only been lurking for the most part the past few days. Some days my own family situation calls for me to attend to other duties I have, not to mention that my pc has been acting up again. So do not fear, I am still here with you all, praying alongside you, and checking in when I can, even if I cannot always post. May God continue to hold Terri in the palm of His hands, and bless her family in every way.

Thanks for the link to the webpage in #90! I have one quick question, which I hope you, or perhaps phenn can answer, please.

Are these actions something the Schindlers are aware of, and encouraging? I remember reading something somewhere (I'm danged if I can find it now) about the Schindlers lawyer suggesting that we back off. I'm glad to do whatever I can to help Terri, but the last thing I want to do is something that the Schindlers or their legal team believes might somehow backfire on her.

I'd like to know for sure that the Schindlers believe this is the right action to take. Thanks!

Not yet -- fv (I think) said the norm is for the decision to be released on Friday. I hope Judge Baird is not just going through the motions here, and that he is taking Terri's wellbeing to heart this time. It is clear to all that she and her family are being mistreated -- esp. after that attack that has shut out her family for the past 3 1/2 wks.

It sounds to me like the guy had free reign at the
nursing home and possibly raped the disabled woman many
many times over a long period. (because 76 year olds
aren't typically noted for their fertility)
The abuse probably went unnoticed until the disabled
woman became pregnant, and then could not be ignored.

In some ways, the story again shows the judiciary's disdain
for disabled persons whose lives don't meet THEIR minimum level of "worth". I say that because the judge
WON'T prosecute the perpetrator, OR EVEN LOCK HIM UP.

It IS interesting he will charge the guy's WIFE with
FELONY NEGLIGENCE because she ran the home. But somehow
I doubt if she will ever serve a day in prison either.

If the 'home' paid the court a whopping fine, I believe all
would be forgotten. The judges in Terri's case are even
worse.

I remember this story now. The woman was appointed a guardian and decided against abortion. I had not heard anything else after the baby born. Prayer does work. .

I moved your comments here to Terri's "daily" thread, because it will have much higher Terri 'traffic' until the next BREAKING or FRONT-PAGE Terri news comes along. The 'connect the dots' you were responding to is also on this thread at post #82.

A great many people have already contacted those state agencies to lodge complaints about Terri's isolation and the apparent decline in her care. They have all received 'form letters' explaining that no wrongdoing was evident.

Problem is: these 'form letters' do not disclose who carried out the investigation, their medical credentials, if Terri was personally examined, if her medical records were in order or if they believed she was being isolated.

Under FS 825.102 (Abuse, Neglect, Exploitation of Elderly Persons and Disabled Adults):

---(b) Willfully tortures, maliciously punishes, or willfully and unlawfully cages, an elderly person or disabled adult;

With the exception of visits from her family, Terri has been in isolation since 2001 when she was transferred to Hospice Woodside. She is not permitted outside, in the common areas of the facility, away from the facility or home with her parents for an afternoon. She does not have interaction with anyone other than her immediate family and caregivers. She is not allowed around other patients.

The responses from the Health Care Administration do not address this. They do not clarify any aspects of their investigation or if complaints should be referred to another agency. This is something they are required to do, as I understand it.

Yes, I believe people should keep on these agencies. They are charged with ensuring the proper care of all individuals. However, I don't suspect any of us will easily get the answers from them. In my personal opinion, they have already decided to stay out of the matter.

Serious pressure would be required to get anything done.

Pardon my typo. Terri was confined to Hospice Woodside on April 10, 2000.
