The FISA, Foreign Intelligence Surveilance Act, came out of the (Frank) Church Commission hearings of '78, and are a direct result of the Carter Administration paranoia. The same paranoia that caused Carter's bunch to fire half the CIA agents as well as their director.
The FISA is the "structural" problem that Condi Rice referred to, much too obliquely.
She should have just spit it out: "When you Dims were in power, you did your best to handcuff the intelligence-gathering activities of this government, and 9/11 is the result!"

This memo compromises the validity of the whole commission.
Where is FNC on this?
This should be a HUGE story! O'Reily makes lip service of "looking out for.." but he acts like a closet Kerry Supporter.
It is already apparent that republicans on the comission lack the stones to put the blame on the clinton years OR the unneeded delay in confirming Bush Administration officials. Instead they will PANDER and APPEASE the democrat party in the name of harmony.
She has a OBVIOUS conflict of interest that demands her removal from the hearing and demands she cease any involvement in the final report.
BTW FNC had a report that the members aides prepare reports. How many of the Republicans have democrats on their staff? How many of the interns are democrats? (ala Mr. Specter)

Would be good to send this info to the Fox guys - John Gibson - Cavuto - Hannity, etc. At least that's a start that might alert more of the public to this.
