Section 871. Threats against President and successors to the Presidency
(a) Whoever knowingly and willfully deposits for conveyance in
the mail or for a delivery from any post office or by any letter
carrier any letter, paper, writing, print, missive, or document
containing any threat to take the life of, to kidnap, or to inflict
bodily harm upon the President of the United States, the
President-elect, the Vice President or other officer next in the
order of succession to the office of President of the United
States, or the Vice President-elect, or knowingly and willfully
otherwise makes any such threat against the President,
President-elect, Vice President or other officer next in the order
of succession to the office of President, or Vice President-elect,
shall be fined under this title or imprisoned not more than five
years, or both.

AG Ashcroft has received numerous death threats. He is below Rumsfeld in the order of succession and people have been investigated, and if memory serves me right, atleast 1 person is in jail for those threats. Ruins your "too far down the line" argument.

18 USC 871 requires next in line. Rumsfeld is not "next" - so that doesn't apply. Arguably 18 USC 115 does. However, I still think it is a tough case and not at all clear cut.

Uh, there's lots of legal repercussions. Just simply lots of them. :) Includes some jail time, fines, etc. Seems threats like these are taken very seriously indeed. I have the criminal code on it's way and will post it for you.

Umm...under what section of US law was that individual put in jail? Not 18 USC 871. That is where the "too far down the line" comes into play.

18 USC 115? Or other sections? I don't think 18 USC 115 is directly applicable due to the intent requirement - though perhaps it is there, but the ad by itself is not enough.

The entire ad is a disgrace....but urging that Rumsfeld be put against a wall & a 'trigger pulled' jumps out as the most despicable!

I said it was only Rumsfeld because the law in this instance would only be a crime if it was the President or VP. You are wrong. See previous post of Title 18 USC..
