Man Arrested for Watching Porn While Driving

Police say 35 year-old Andre Gainey was driving near the Schenectady Police Station Tuesday night. A detective in an unmarked car noticed Gainey watching the pornographic movie "Chocolate Foam" on a dvd screen inside his green Mercedes.

You bring up an interesting point. We were leaving a friends house the other night, and the neighbors across the street had their curtains wide open and a porn flick showing on their large tv screen. We're not nosey enough to call the cops on such because it was very late at night, and no children were running around outside. Should we have reported them?

Next step is to have government agents peering into our windows to ensure we are only viewing government approved material.

Or going into peoples' houses to discover they're engaged in unsanctioned consensual activities. Oops, already happened in Texas, and that got struck down.

The way the law was written it allows for arrest when anyone can see obscene material, to include cars. It could also be used to homes. That is what my comment was directed to, I wasn't espousing that anyone has the right to "flash your porn in the faces of others."

Why wasn't Janet arrested?

two theories: Is "Chocolate Foam" perchance a Gay porn movie? If yes, gthis may be a way for gays to cruise each other. Who knows?

Second theory: our subject here is another example of a new mental illness pandemic called (my name) "porn psychosis" -- meaning extended exposure to porn (facilitated by the Web, of course) is slowing rotting out his brain wiring. BTW, I see cases brought here in Virginia every week where that is the only plausible explanation. Or maybe its not just the porn, but the 'perfect storm' caused by porn and Viagra.

It would make for a very nice tool for revenge against a neighbor that you don't like. In my neighborhood the homes are pretty close to the sidewalk and seeing what is on people's TV is easily viewed when I am out walking my dog.

Considerate people would close the curtains, but then there is always the inconsiderate.

Only regarding homosexual consensual activities. Not with regards to any other consensual activities. i.e. drug raids.

I sure as heck hope backseat screens are still legal, Im driving to Texas tomorrow and its one of the best methods to keep the kids quiet.

Inattentive driving, while not necessarily involving dangerous maneuvers, is still an infraction in most states.

No, but maybe you should have contacted them about their incredibly ignorant actions. They may not realize everyone can see.

If they do realize everyone can see, I see no difference between their actions and the actions of a pervert who exposes himself to kids through his window.
