Appeals court ruling favors Terri Schiavo's parents

TAMPA, Fla. -- Gov. Jeb Bush and the parents of a severely brain-damaged woman won two appellate court victories Friday in their quest to keep her alive against her husband's wishes.

The 2nd District Court of Appeal ruled that Bush's attorneys will be allowed to question witnesses in the court battle over a law that gave the governor authority to reinsert Terri Schiavo's feeding tube after her husband had it removed in October.

The appeals court also ruled that Pinellas Circuit Court Judge W. Douglas Baird did not follow judicial rules when he denied her parents, Robert and Mary Schindler, the ability to intervene in the constitutional challenge to the law.

The appeals court ordered Baird to hold further proceedings on the issue.

Schiavo's husband, Michael, has been battling the Schindlers in court for years to remove Terri's feeding tube so she can die. He says she would not have wanted to be kept alive artificially.

The Schindlers doubt their 40-year-old daughter, who lives in a Clearwater nursing home, had any such end-of-life wishes and believe her condition could improve with therapy. Their daughter has been in a persistent vegetative state for more than 13 years after collapsing from a chemical imbalance.

the husband sued for malpractice on Terri's behalf and she won alot of money to be used for her care and rehabilitation....it was her money and there was plenty there to take care of her. Her condition might be terminal but it her death is not imminent unless her husband gets his way...then it is called murder and she will die in agony. You can sugar coat it all you want but truth is this: It is murder

Persistent Vegatative State. Same thing, and you know what I mean. Bottom line is, the situation is a tragedy. The poor woman has been laying in a vegetative state for 13 years, and the sad fact is that the circumstances of her life, her marriage, her family, and now her death are just tragic.

The only thing more tragic than what happened to her is the fact that a bunch of fanatics, on both sides, are using her lifeless lump of flesh as a banner for their cause. There are some people riding Terri's coattails who make me sick.

Terri is not terminal. She is not sick with any disease. She requires a whole lot less care than Christopher Reeve. The difference between them is that Terri's spouse does not want her to live. Reeves' spouse does.

Felos keeps saying she is in PVS, but like everything else he says, this is not true. There are doctors that have testified that she is not in PVS.

Why do you only believe Felos and his gang? and not the doctors consulted by Terri's parents, who also examined Terri?

I believe that Baird will take the corrective directive that he received from the appeals court with great outrage and deep-seated anger.

It is amazing what the press chooses to leave out of their stories. They only tell part of the story. The part they want the public to know

Like I said, I'm no doctor, and the Courts are handling the issue. And I agree that the situation creeps me out, and I have felt uneasy about the husband and his motivation.

Don't lose track of the point. Saying that he's trying to kill her, as opposed to withdrawing her life support, is a big difference.

If you want to be dehydrated and starved to death should you find yourself in Terri's situation, be sure to note that in your dnr order. Terri did no such thing. She did not ask to be starved and dehydrated to death should she be unable to communicate. She did not leave any such directions. In fact, her so called husband said he needed money from a court action to take care of her! Yet he did not provide any rehabilitation for her.

If that is the way you want to die (a horrible death by starving and dehydration) let your heirs know now. Terri never asked for that, nor deserves it.

I'm glad you posted that picture. For those of you who don't know, this picture was published in Terri's local newspaper around the time of the malpractice hearing (1991-92) And Michael may argue, but I can't imagine a newspaper sending a photographer out to snap a picture and would spend 4 hours trying to get such a nice shot! Which is what he claimed the Schindlers had to edit to get video of Terri that showed her responding! Yes, responding! It means Terri's NOT PVS!
