This is a Hospice Patients Alliance Special Update Jan 5, 2004, sent out periodically to inform the public about news affecting hospice and end-of-life care.
We have just confirmed that ALL of Judge Baird's cases, INCLUDING the suit by Michael Schiavo v Gov Bush related to the Terri's Law, challenging its constitutionality, HAVE been transferred to Judge Nelly Khouzam. This information came directly from Judge Khouzam's assistant. Judge Khouzam is known to be a "by the book" tough, but fair judge.

The court is NOT explaining why the judges were suddenly switched, except to say that "judges rotate from time to time." We believe it might have something to do with:
Local PINELLAS COUNTY COURT BAILIFFS AND COURT EMPLOYEES WERE TAKING BETS ON WHETHER TERRI WOULD DIE OR NOT!!!
It was widely reported that Judge Baird made reckless and prejudicial comments in support of Greer and Felos and against Jeb's lawyers way before he had heard the evidence from the Governor's attorneys.
In other words, Judge Baird's comments are the likely reason local Pinellas County employees were doing "inside betting" that the local Pinellas County Judges would back each other's poor and constitutionally illegal decisions against Terri's constitutional rights and thus overrule Jeb Bush and Terri's Law. The 6th Circuit Judges are upset to have anyone tell them they are morally and legally wrong...... whether it's constitutionally illegal or not to murder Terri.
Conducting inside betting on the case is a severe violation of the code of conduct for court employees! Whether that is, or is not, the reason the judges have been switched, the very important change in judge can be extremely significant to what happens to Terri. We are hoping that Judge Khouzam will give the Gov a fair hearing in the case and allow the discovery he sought (which was denied by Baird). If Judge Khouzam allows some discovery as requested by Gov Bush, it could make all the difference!

I posted a fact, I didn't comment on whether or not the "Betting" incident is true or not. All I stated is that the bailiff that I happen to know was not aware of it. I made no claim that his statement was dispositive.
No one on these threads has posted anything but allegations re the betting. Some even admit that they don't know whether it is true or not and further, there has been no source for the allegation. I haven't read anything here by someone who claims to have witnessed the activity.
Did you witness it, or do you have a source?

Someone leaked this from the Pinellas County Court system. It's up to Bernie McCabe to investigate whether the allegations are true. This is no longer just a PR problem for the Sixth Circuit. It's indicative of a sick Circuit where heads should roll.

And, people don't realize there's more than one court complex for Pasco-Pinellas. It could be happening at one of what is it, 3 or 4 court complexes. There's downtown St. Pete, the criminal complex, downtown Clearwater. Can't remember if there's another one. It only takes two people betting to make it ILLEGAL and prejudicial.

Facts and surmises: I know one of the bailiffs at the Courthouse personally. He used to be a patrol officer with the Pinellas County Sheriff's Office. He has left the street and is now a bailiff. He told me that he is unaware of any such betting. I've known him for the since 1988. I've no reason to doubt him at all.
Facts as you testify to, fair enough.
But a surmise, why through contextual surmises a reader is led to induction and inference, And a writer must be careful in their application.
And facts, when ordered or filtered themselves suggest or create a surmise that leads the reader's mind down stolen byways.
And what here? The induction that your baliff, being totally faultless and trustworthy, is a man who knows ALL that occurs in the courthouse. That, well golly, if'n a lottery was so held he would of course have been aware of it.
An induction surmised and not a fact -- but drawn from the surmises you adeptly placed in your statement. Not all fact, not all fact at all.

I don't see any mention of having Governor Bush's attorney on at the Fox website. Where did the info come from that she was going to interview Bush's attorney tonight? Was it on a promo for the show tonight?

maybe Greer and Baird had a good old boy agreement that they didn't need checks and balances because they have made themselves all powerful....so much so that they can get away with murder. These guys are making their own rulings based on their own sense of the law which is totally unethical. Are these guys appointed or were they voted into office?

I'm proud to say that I DID NOT VOTE FOR J. GREER IN 2002. I voted "no" on retention. Something was already bothering me about Greer but I didn't even know about Terri until the end of August, 2003. If I voted "yes" on Baird, everyone, please forgive me. It won't happen again.
