Dem Probers Eye Rush's Medical File Despite Agreement[Fr mentioned]

A Democratic Party prosecutor ordered the review of confidential medical records seized from doctors treating number one talk radio host Rush Limbaugh - despite an agreement by his deputy not to do so at a Florida court hearing Monday.
The brazen legal move has Limbaugh's supporters worrying that his medical secrets may now be in the hands of senior Democratic Party operatives working for New York Senator Hillary Clinton and other top Democrats.
During Monday's hearing, Limbaugh's attorney Roy Black asked the court to stay an expected decision granting permission to review the medical data until an appeal could be filed.
During the following exchange among Black, Assistant State's Attorney James Martz and Judge Jeffrey A. Winkoff, Martz indicated that he didn't object to the bid to keep the records under seal pending the judge's ruling.
"I honestly think it's in the purview of the Court to make that decision," replied the Florida prosecutor. "I don't think I have an argument on that."
Despite Martz's apparent agreement that the records would stay sealed until Judge Winkoff ruled, Limbaugh's records were allegedly opened and reviewed on orders from Martz's boss, State's Attorney Barry Krischer, the top talk host charged on Wednesday.
"The state advised my lawyer later in the day, [Monday] that, Barry Krischer, who is the elected state attorney down here, told his investigators to go ahead and open my medical records, despite the requests from my lawyers and the consideration of a stay by the judge. . .
"They couldn't wait; they had to open them," Limbaugh complained. "The state's attorney, Barry Krischer, personally ordered it from what we're told and his investigators began rifling through my medical records."
Contacted by the Palm Beach Post on Wednesday, State Attorney Krischer refused to deny the allegation.
The move shocked the top talk host's fans. Writing on the conservative Web site FreeRepublic.com, one listener worried: "The contents of Limbaugh's medical records are undoubtedly already in Hillary's database."
Kischer is a Democrat who strongly backed Attorney General Janet Reno after she was selected for the job by Mrs. Clinton.
Krischer's decision to press the case against Limbaugh so aggressively drew criticism from one particularly unlikely source.
"There is something odd about the way this case is playing out, the kind of crimes that are being investigated," complained former White House counsel Lanny Davis to MSNBC on Monday. "And it does really look like his celebrityhood . . . has attracted unfair attention."
While Davis disagreed with the notion that Limbaugh was the victim of a Democratic Party witch-hunt, he observed, "It doesn't look like, at the moment, they have a real serious case that smacks of criminal conduct."
"This is about prosecutors leaking to the press. That's wrong. And I agree with Limbaugh on that," he said.

(The judge denied the request to quash the Search Warrents on Monday and the prosecuters informed Rush's lawyers and opened the records. Where is the liability ?)
The judge informed the prosecuters to wait and they had no problem with that...except they did open the records before giving Rush's lawyers time to respond. I don't know about liability but the prosecuters took advantage.

Rush is not out of the woods.
If he has taken all these pills legally, he should be fine. But if he got them on the black market he deserves whatever he gets.
He after all, Rush is the one who's blathered for years about how tobacco is a "LEGAL" substance (as opposed to marijuana, etc.) and how tobacoo therefore should not be subjected to chronic arbitrary regulations, & blah-blah. As a libertarian, which Rush isn't, I feel little sympathy for him.
He's also been quick to the sword when Libertarians have called him to defend individual liberty in all personal decisions - immediately asking them if they are on drugs/or in favor legalizing drugs, and etc. right out of the starting gate. Like this statement - which is obviously correct, they DO favor legalization - somehow negates their [more principled] postion on personal liberty relative to the av. Republican's anti-drug war philosophy. (Wm. Buckley - & many other conservatives who publicly support drug legalization - excepted.)
Rush still hasn't said, up front, "I did not buy drugs on the black market, and did not instruct my maid to do so."
If he can say that, plainly & unequivocally, then -- maybe he won't look like he's spinning as he does now. He's been acting like Clinton lately, with the "I have rights" and blah-blah. Just SAY: "I DID NOT BUY DRUGS ON THE BLACK MARKET" Rush! How HaRD is that?
Too bad he isn't a libertarian like his guest host Prof. Walter Williams, to begin with. Then he wouldn't appear the big hypocrite he does right now. I still listen, but -- I have lost a lot of respect for the guy. He sounds like he's prevaricating most of the time, playing with legalities, etc.
By the way - what is Rush using for his various aches & pains nowadays? He doesn't seem to be in much pain, right now (from hearing on the show the past couple weeks).

Whats with you on the "Kennedy Lawyer" barb ?
I rather this have broke now as opposed surrounding the 11/02 elections. I believe RL lost his hearing due his opioid addiction, and this from a guy who loved music.
Add the public confession and treatment, that is a harsh nonlegal punishment.
All this seems tacky on a Holiday. You should join Rush 24x7 in way of thanking him for the epic journey he has taken Conservatism and Republicans on.

It looks to me that they waited until he originally denied the request to quash -which they did not HAVE to do - then they opened them.
Rightfully so... are they supposed to wait to see if he changes his mind and reverses himself ?
They are performing an investigation, when a judge rules that its OK, they continue with the investigation.

The party has their own prosecutors now? They've had them for a while now. Remember Linda Tripp's indictment?
I believe it was the Howard County Democrat Club and Robert The Weiner who were exposed as lobbying the Democrat state prosecutor to indict Tripp.
Even though the law had a MAJOR loophole in it that you had to know of the law to violate it. Also, the conversation was interstate, not intrastate.
But that didn't stop the fascist Democrat from using the power of the People Democratic Republic of Maryland from going after an "enemy of the Democratic State".
They didn't need to win. The objective was a show trial in the press, to smear here. To also take up her time, complicate her life and to cause her to incur legal fees.
Yes Virginia, there is a Santa Claus, and he'll tell you that Democrats are the closest thing to fascists that the US has.

Were the Nazis famous for humiliating people or killing them? More for killing, but they did a lot of things to humiliate those "on trial", much laike the Democrats are trying here.
Hilter had a "People's Court" long before there was Judge Wapner. It was common for them to take belts from male defendents so they's have to hold their pants up while testifying. Remember the famous Nazi newsreel of the bomb plot conspiritors? The Judge in the funny hat that looked like a Monseignor's hat?
The Nazis often humiliated the Jews before killing them. Petty stuff, which is oh so horible when you think that the same people who killed them had time for such pettiness in the midst of evil. But perhaps it's because I don't understand that those folks had no conscience.

And does the legal court process here smack of Nazism to you? I agree the Nazi's were bad people, to compare this Rush situation to the crimes of the Nazis either is greatly overstating what Rush is up against or belittling what the Nazis did. I think it was just a poor choice of adjectives.

I hope rushie is treated just as fairly as he has treated others over the many years... I'm sure if there is nothing in the allegations/speculations to be concerned with then this issue will drop.....
I didn't bring up this article on Christmas day. Newsmax seemed to have put it out and someone posted it....

There is a whole heck of a lot of alleging going on all the way around. If Limbaugh had taken a quarter of the drugs he's alleged to have bought he would have died. I think you've hit the nail on the head! That's why the prosecutors want to review Rush's medical records. If he really was purchasing as many drugs as has been alleged then he must have been supplying them to someone else! Otherwise he would be dead or was hoarding huge quantities.
I also think they want to know if the drug use began after his alleged back problems.

And does the legal court process here smack of Nazism to you? Abuse of the legal system, abuse of government power was what Nazism was all about. So Yes, this Democrat jihad smacks of Nazism.
That was what made the Nazis powerful, they gained power and then seized it for themselves. Party and government became ONE. Ever hear of the Waffen SS? That was the National Socialist Worker's Party military machine. Imagine Terry McAuliffe having infantry divisins, tank divisions and other formations that belongs not to the US Government, but to the Democrat Party.
For the most part here in the US, at least the winners of the elect see themselves as temporary. The Nazis saw no boundaries. If you could use a court to accomplish a political goal, fine. The hotel owners won't sell so you can have a Nazi Party conference center, arrest them.
In a lot of ways, this Democrat prosecutor in Florida is taking baby steps of Nazism. Let's hope for the nation's sake he falls on his little ass.
