It looks to me that they waited until he originally denied the request to quash -which they did not HAVE to do - then they opened them.
Rightfully so... are they supposed to wait to see if he changes his mind and reverses himself ?
They are performing an investigation, when a judge rules that its OK, they continue with the investigation.

I thought the prosecutor indicated they would have no problem with waiting on the
9.310 stay should the judge be inclined to decide his way.
