Good question - there are Christmas trees in many government places (eg, White House Christmas Tree lighting, among many others). The places where you hear about the ACLU crowd freaking out about religion are mainly public schools and courts. Here in California, every new session of the legislature starts out with a public prayer. So does the U.S. Congress.
