No, but look at the first hundred posts on this site and you'll see some posts about it. I was there when someone mentioned something to the effect of: 'That's odd, the numbers on Frist's site are way different then they were earlier. There's even a lot less votes than before'. A few minutes later the Democrats said that 'Even on the Senate Majority leader's website the American people have overwhelmingly voted in a poll that they do not support the filibuster'.

That's when we figured out what happened. They used it as a talking point the rest of the night.

The Founders did not give the Constitution the ability to defend itself, unfortunately. The Constitution, to a large degree, is whatever at least five Justices (a majority) interpret it to be at any given time, based on their ideology, and regardless of what the Founders intended or what the citizens expect.

The Founders couldn't give the Constitution the ability to defend itself, but they did provide for checks and balances even regarding Constitutional interpretation. Historically, the presidency and Congress have claimed the right to independent interpretation and, in some cases, have even acted on it. Presidents have ignored Supreme Court rulings. So has Congress.

In fact, under the Constitution, Congress has the power to limit the appellate authority of the Supreme Court but that power has not been exercised recently, if it ever was.

As a result, the vast majority of the public today believes that the Supreme Court has the final say on constitutional intrepretation. That's why there is so little understanding, even on Free Republic, of the issues at stake in controversies like that of Justice Moore's refusal to be bullied over his Ten Commandments monument.

My letter to the esteemed Sr. Senator from CA:

Dear Senator Feinstein,
I am absolutely incensed at your votes to continue debate and block the confirmation of the justices nominated by the President. Specifically I am offended that you would not only refuse to support, but actively work to defeat the confirmation of Justice Brown who has served this state, your state, well and ably. Her support within your constituency was 76%, better than your own. Yet you have chosen to ignore the good judgement of the people whom you purport to represent. Your actions on this matter will be remembered should you choose to seek re-election, and you will be called to account for your lack of judgement and adherence to party politics over principal. Perhaps you should pay attention ... the recall should have shown you that the people of CA are paying attention, and we refuse to allow our elected officials subvert our will any longer. There is time and opportunity for you to correct this gross error of judgement, and it is my great hope that your conscience will guide you properly.

A total rejection by the voters of the liberal agenda along with a Republican landslide will send a clear mandate to government at all levels for a return to our traditional conservative American values.

And even parts of the Constitution that *can't* be misinterpreted will be misinterpreted. The most perfectly designed constitution will fail where the character of the people fails, as John Adams warned:

  "It is religion and morality alone which can establish the principles upon which freedom can securely stand. Religion and virtue are the only foundations ... of republicanism and of all free governments."

Adams also observed, "We have no government armed with power capable of contending with human passions unbridled by morality and religion . ... Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other."

A citizenry largely unrestrained by morality and religion is the root cause of the difficulty of our political struggles with leftists. Ultimately, the problem isn't the strength of our opponents but our own weakness facing them.

In fact, the Members of Congress are well aware of their capacity to limit the jurisdiction of the federal courts, including the Supreme Court. Congress has done that at least six times that I know of. The last time was a sneaky little ploy by Tommy Daschle in the last Session of Congress.

There are bills pending in both the House and Senate now that would strip all the federal courts of their "God" jurisdiction. If I were there, I'd push that issue nine ways from Sunday.

Folkes we have not lost the war nor this battle. The more this is brought out into the open, the more the sheeple will have their eyes openned.
