Florida lawmakers jump into Schiavo case

George Felos, attorney for Michael Schiavo, said he thinks the legislation would be unconstitutional. It is Terri Schiavo's right under the Florida Constitution to not be kept alive artificially, and the courts have affirmed that, he said.

Felos characterized the group's efforts as yet another attempt to undo repeated court rulings in favor of Michael Schiavo.

In June 1998, soon after Michael asked the court for permission to remove Terri's feeding tube, the court appointed Richard Pearse as Terri's guardian ad litem. His job was to investigate the facts of Terri's case and represent her interests in court.

At the 2000 trial, Pearse concluded that he had not found clear and convincing evidence that Terri would have rejected life support.

Pearse said he was troubled by the fact that Michael waited until 1998 to petition to remove the feeding tube, even though he claims to have known her wishes all along, and that he waited until he won a malpractice suit based on a professed desire to take care of her into old age. As her husband, Michael would inherit what is left of her malpractice award, originally $700,000, which is held in a trust fund administered by the court. Accounting of the fund is sealed. But Michael's lawyer, George Felos, said most of it has been spent on legal fees associated with the custody dispute.

Pearse also said he did not find Joan and Scott Schiavo's testimony credible.

Greer ruled in Michael's favor. Appeals by the Schindlers failed. A state appeals court upheld Greer's decision; the Florida and U.S. supreme courts declined to hear the case. And on April 24, 2001, hospice staff stopped feeding her. But two days later Pinellas County civil court Judge Frank Quesada ordered that feeding be resumed when evidence suddenly surfaced suggesting that Michael never really knew what Terri's wishes were.

What "evidence" ? You mean because Schiavo and HIS brother and HIS sister-in-law said, uh...we think she said something like that...uh... maybe 15 years ago, while we were watching a movie -- but don't ask what movie it was, we don't remember!

You mean, THAT'S evidence???

I don't think so.

The courts are often grievously wrong. Witness Roe v. Wade.

And witness the Florida courts in the 2000 election. We very nearly had to get a legislative remedy there.

So no, I don't fear an occasional legislative remedy to abuses of the courts. It's constitutional!

It also means that from this time forth citizens will be at the mercy of ANY family member who might disagree with their confided medical choices.

I believe you're wrong. The bill as I understand it limits the circumstances under which a family member may object to situations where (a) the patient has no written record of his/her wishes and (b) the patient is unable to speak for him/herself.

It will require that people in Florida hence forth need to pay lawyers to prepare living wills to protect their rights when it comes to medical choices.

This is not a serious objection, as you recognize yourself. There are forms you can download from the internet, or copy from a library book for 15 cents a page and get notarized for free at your bank. If such forms, like wills, are not considered legally valid, then we can lobby our legislatures to make them so.

What evidence? Either she is brain dead or she is not brain dead, period. If, as her husband, Michael Schiavo and his attorney, Felos, contend that she is brain dead - then how, pray tell - did she convey that she wanted to die to her husband? That would be truly miraculous and I am into miraculous so I would like to know. Schiavo/Felos conflicting arguments - collusion/delusion!

What absolutely terrifies me is that two of the NAY's sit on Health, long term care and aging committees.

It's also scary that Greer has been a speaker at least one conference for the elderly and disabled.

I know that the article is 'old' when considering Terri's fate.....but it does show him fighting for the elderly and disabled. Why his terrifying stance on Terri?

Once again, the most threatened minority on Earth have experienced that the Right-to-Life is only recognized, and socially and politically acceptable by those who are capable of violently and militantly defending their rights. As Hitler insisted, the weak and the strong cannot coexist, especially in war. So, the weakest people have to be killed off by the strongest, so that only the strongest will survive.

Disabled People are not going to be allowed to survive, unless they become the strongest and most militant force on Earth. Governments and courtrooms are demonstrating that, and today's repeat execution order by the same judge in Tampa Bay, Florida clarifies that point. That is the way American society and culture is, and is why the entertainment industry specializes in violence more than any other type of movies and television shows produced.

In a seemingly deliberate attempt to win their case, regardless of the intense level of domestic violence which Terri Schiavo was subjected to prior to her alleged attempted murder, Michael Schiavo's lawyer fired away with absolutely proveable lies last Friday, November 15 which witnesses can testify to. Because of George Felos' strategy, conditioning the court and the public to assimilate everything he says as fact, and the way it is, I take pleasure in stripping him down of any credibility he hopes to have in the results of Terri Schiavo's death row judgment. The point is well illustrated when Felos replied to questions regarding beating or hurting Terri. He replied: "Absolutely not!--Never!" In this response, George Felos is conditioning the court to refute and discredit the witnesses to Michael Schiavo's behavioural disorders, and psychotic rounds of violence. This should alarm and move people to action against lying, belligerent lawyers.

Diana Lynne, a WorldNetDaily news editor reported in a November 19, 2002 article "Removal of guardian sought in right-to-die case", that Judge Greer's first verdict was appealed and an appellate court scheduled another trial, which was held during October 2002 to assess Terri Schiavo's current condition, possible treatments available and whether they would be efficient for her, as well as their acceptance by the medical community. In a medical community which is divided by those seeking to promote recovery, advances in therapy and the right to life on one hand, and those who impose their personal contempt and prejudices against people they don't consider worth living, Terri Schiavo's chances of fairness in such a decision are slim. Last Friday, in an emergency motion submitted by Pat Anderson, on behalf of Terri's parents and family, to take legal guardianship away from her abusive husband and suspected assailant, Michael Schiavo and George Felos worked hard to discredit information which surfaced in last month's trial, and are aggressively bullying through with Terri's court ordered execution by starvation and dehydration.

A clear example of his agenda to disregard the many years of injustices against Terri-Schindler Schiavo, and instead of compensating her for her sufferings and enabling her to recover and enjoy the rest of her life, but rather, railroad her execution, George Felos flew off at the mouth on November 15 among several babblings, that claims of abuse and neglect were raised in three prior petitions denied by the court. Schindler's lawyer stressed the bone scan had never been litigated nor came to light in the trial record, in the medical malpractice lawsuit. So, I have a serious challenge for such irresponsible, if not criminal negligences in courtrooms: If claims in three petitions had previously been denied by the court, of neglect and domestic violence, that judge needs to be dealt with, as well as any other elements of obstruction to true justice. Courts are supposed to be halls of justice. The Merriam-Webster dictionary defines "justice" as: "the maintenance or administration of what is just, especially by the impartial adjustment of conflicting claims or the assignment of merited rewards or punishments". Don't you think it is high time to clean up courtrooms, and repair the disabled justice system? In no uncertain terms, isn't it time the judicial system got fitted with a feeding-tube?

The argument over Terri Schiavo is over life-support. In Florida, feeding-tubes are considered a form of life-support. The Right-to-Genocide terrorists insist that feeding-tubes are a means of keeping people alive artificially. If we want to maintain an execution list of people being kept alive artificially, we can safely shutdown the entire genetic engineering industry. That alone can free up probably tens of billions of dollars annually, since one of the chief cards the Right-to-Genocide militants play, is the cost of healthcare to help people like Terri recover, and enjoy her life, regardless of her disability. To disconnect her feeding-tube, she would die of starvation and dehydration they say.

Well, guess what!--If you, me or anybody else stop eating, and drinking fuids, just what would you expect to happen? In April 2001, poor Terri already got a taste of what it is like to be starved to death, while her courtroom killers, namely Judge Greer, Michael Schiavo and his lawyer went out to fill their own guts, and drink to their victory. All that saved her after three days of a slow, gruesome fate, was the intervention of an appellate court. If we allow Terri's execution for using a feeding-tube, next on the growing list will be everyone using ventillators.--Get the point?

A Brooklyn, New York Orthodox Rabbi named Yehuda Levin, at the rally outside the courthouse in Clearwater, Florida, represented approximately 1200 North American Orthodox Rabbis in support of Terri Schiavo's right to live. Here are a few of his statements: "What happens here will have a profound effect on what happens to life and living in America." "If death by electric chair is 'cruel and unusual punishment,' what is death by starvation? A party? A bar mitzvah?" "Terrorists will not get death by starvation, why Terri?"

In Diana Lynne's article of November 19, she quotes George Felos as saying: '"The opposition has a pattern of dredging up filth in order to attack my client because ultimately they're going to lose on the merits of the case, which is what the current medical condition of Terri is and what her wishes are. ... They're just attempts by the Schindlers to run an end-run around the ruling to end life support," Felos told WND.' It seems like Geroge Felos is a self-appointed expert on filth. He presents himself like an expert on everything. How dare any other witnesses be listened to, because this guy is getting rich and famous from Terri's dwindling malpractice funds, which were intended for her medical care! Maybe the merits of Terri's case shouldn't revolve around her current medical condition. As far as her real wishes, how can we know her real wishes, when the witnesses who insist that she let them know her choices, are the conspiring killers themselves? On Friday, I plead with everyone who reads this article, to stop any decision to execute Terri Schiavo.

To show how docile Felos really is, he considered the note on the bone scan report "evaluate for trauma" as only "defensive medicine" on the radiologist's part. Mouthy, arrogant Felos spewed out that the radiologist was trying to protect himself, and justify his conclusion. This guy isn't really a lawyer. I think he is a sick piece of work, who needs to be treated. Just what the hell did the radiologist have to protect himself from? What justification did he need to have in any conclusion he reached? I think George Felos has serious mental disorders, and doesn't deserve to be treated like royalty. Put a stop to the Right-to-Genocide terrorists, and stop any judgment which prevents Terri's real family to gain legal guardianship, and help her recover from twelve years of horror.

Before I close, I hereby challenge the dishonourable, verbally militant and psychologically abusive George Felos, to his puny effort to explain away the nuclear imaging bone scan performed approximately one year after her supposed heart-attack and brain injury. At the time of the bone scan, Terri was around 27 years old. He claimed that the scan was done to determine whether Terri suffered from heterotropic ossification. Felos' wimpy explanation of Terri's multiple bone fractures and broken neck nearly seem like a doctor's hypothesis. All it really is, is his attempt to portray Michael as a poor victim of the Schindlers, so him and Michael can continue to cozy up with each other in making profits from Felos' book, and popularity wave lecture circuits. Personally, I don't buy this garbage propaganda that a twenty-five to thirty year old woman suffers from Osteoporosis, and I couldn't care less about Felos' medication and laying in bed fairy tale. If she had been between fifty-ninety years old, I might have considered it possible. But, any court which blows off and plays down the likely cause of her broken neck and multiple bone damage due to her spouse's known violent temper and behaviour, needs to be shafted.

George Felos is no more a bone specialist than I am. George Felos actually had the balls to explain away a detailed report by a skilled technician who deals in such technolgy. The only skill I attribute to Felos is his ability to be a mouthy, disrespectful charismatic preacher of death. His performance in last month's trial, and last Friday's petition illustrates his agenda to finish off Terri's execution, and get paid for being Michael's accomplice to murder--the legal way! The time to stop court-ordered execution of domestic abuse victims, and Disabled People is NOW!

Email and phone government officials, the media and healthcare providers. Get vocal, and if necessary take to the streets. Are you going to allow Terri Schiavo to be executed by starvation and dehydration, while her courtroom killers wine and dine to their latest victory? Demand that the US government STOP the AMERICAN GENOCIDE!

Prayer Trumps Politics and Evil
in a Florida Courtroom

The day opened ominously for Robert Schindler. While many citizens were hanging out their American flags and remembering the events of September 11, the darkest day in recent U. S. history, Bob Schindler shook the depressing thoughts from his shoulders and prepared for a court hearing. This was the long awaited day, the day of the “death hearing,” the day he would hear Florida probate Judge George W. Greer issue a starvation order for his thirty-nine year old daughter, Theresa Schindler Schiavo. Bob Schindler was tired; he and his wife, Mary had been locked in a major battle with Terri’s husband, Michael Schiavo, her court appointed guardian, ever since she mysteriously collapsed thirteen years ago. The last five years were spent trying to prevent the Florida courts from granting Michael’s petition to remove her feeding tube through which she receives food and water.

Although brain damaged, Terri smiles at her mother and is capable of a limited range of actions. A number of medical experts believe Terri can learn to eat and drink on her own, but the courts denied a swallowing test. Thirteen doctors have testified that she is not in a persistent, vegetative state. Nevertheless, the courts consistently ruled in favor of Michael Schiavo in his relentless pursuit of Terri’s death. After Michael was awarded in excess of a million dollars from a malpractice suit, he remembered that Terri once said she never wanted to live on life support systems and began preparing for her funeral.

As Bob Schindler apprehensively approached the courthouse, he saw a number of supporters holding signs, “Let Terri Live.” When Schindler entered Judge Greer’s courtroom accompanied by his son and daughter, he quickly realized that most, if not all of the occupants were either supporters of Terri or members of the media. Nearly everyone was dressed in black. Terri’s mother was at the St. Petersburg Hospice at her daughter’s bedside, seemingly to ward off any news of the judge’s decision from reaching the ears of her handicapped child. When attorney George Felos, entered the courtroom with his partners, his client, Michael Schiavo, was noticeable absent.

A hearing presumably planned for thirty minutes at most, turned into a three-hour struggle between the Schindler’s two female lawyers, Pat Anderson and co-counsel Celia Bachman and Schiavo’s right-to-die advocate, George Felos. Anderson and Bachman were outstanding in their defense of Terri’s constitutional rights. Anderson read into the record the statements of two speech-language pathologists who claim Terri is an excellent candidate for rehabilitation.

Bachman presented new insights on Florida’s guardianship laws, laws that apparently have been flagrantly ignored by Schiavo and the administrative system. The attorney’s fiery presentation appeared to catch Judge Greer off-guard, as she forcefully demanded the court do its duty to see that Terri’s welfare and rights are secured.

When a soft-spoken Greer asked shouldn’t he schedule a date to remove the feeding tube, Bachman fired back, “…fine, go ahead. But your obligation is to give her a transition into being able to ear naturally, by herself, because doing anything else is against the law, against Florida statuettes, and it is state-assisted homicide.” Anderson came in with a thrusting challenge, “…guess what – Terri never said she didn’t want to eat.”

Felos went pale. “Terri wants to die,” he said. He said she must die, because this is what she wanted. “We owe it to Terri.” The previously solemn crowd yelled “NO.” Felos consistently referred to Terri as PVS and a “lifeless human.” He characterized the Schindler’s efforts in trying to save their daughter’s life as “ludicrous” and a “waste of the court’s time.” He accused Terri’s parents of “creating confusion” with their desperation tactics. Lastly, Felos played the religion card.

Felos claimed that Father Gerard Murphy, a former St. Petersburg priest who gave inaccurate and muddled testimony regarding euthanasia in Terri’s case several years ago, was the “end-of-life” spokesman for the St. Petersburg diocese. Felos attempted to use the priest’s statement to prove that the Catholic diocese was in favor of euthanasia. He also claimed that former retired Bishop Thomas Larkin, who supported Terri, agreed she should be allowed to die.

The audience was made up largely of Catholics who were familiar both with Bishop Larkin’s support for Terri and Fr. Murphy’s false testimony. They had long deplored the fact that Bishop Robert N. Lynch did nothing to correct Murphy’s testimony or to support the Schindler family in their battle against euthanasia. In response to Felos’ comment on Larkin, they spontaneously shouted, “Not TRUE!” and said “Felos is lying.” The bailiffs appeared ready to escort the people out of the courtroom but didn’t ask anyone to leave. Two women sat silently praying the rosary. Others were praying silently also. David Pritchard, the Webmaster for the Terri Schiavo Foundation ( http://www.terrisfight.org) whispered, “Can you feel the evil in here?”

Anderson countered Felos’ statement regarding Fr. Murphy’s testimony saying the priest was not speaking on behalf of the diocese but was expressing his personal views. It is well recognized that the Catholic Church opposes euthanasia. Fr. Murphy has since asked for a leave of absence from active ministry and is no longer working in the St. Petersburg Diocese.

The noon hour approached; Judge Greer repeatedly looked at his watch. Felos approached the bench and asked that Terri’s feeding be disconnected at 5:00 p.m. Eastern standard time. Felos had commented earlier outside of court that he intends to write a book about the Terri Schiavo case. No doubt having Terri’s death begin on the date of the infamous terrorists’ attack of 9-11, would add even more drama to an already agony-saturated saga. Judge Greer’s announcement to postpone scheduling until next week so that he may study the latest presentations came as a much-welcomed surprise to all, probably the first significant set-back Felos and his client Michael have experienced. For once, prayer trumped politics and evil in a Florida courtroom.
