So you'd be willing to go into a restaurant not knowing whether the owner bothered to refrigerate the meat the night before. Food preparation is under the FDA Regulations. Tobacco, still today, is not.

Per the RP McMurphy's restaurant, I would like to see a fund set up where those of us who believe in business and customer rights (smoke or no-smoke by choice) could contribute to a legal defense fund. The owners and patrons of RP McMurphy's have made it clear they don't intend to comply with state law and have posted a sign at the door so patrons know in advance they are entering a "smoking zone." Any thoughts on this?

I realize that. But you said "WRONG" to the contention that every restaurant is already regulated in some way. The poster was NOT saying that every restaurant is regulated as to smoking -- he or she was saying every reastaurant is regulated in some way. I was questioning why you would say this is not so when it obviously is.
