One of the silliest things that smokers do is to claim that the government somehow has no right to regulate health issues in businesses that serve food or drink. Where have you people been all your lives? Ever hear of state hotel and restaurant commissions? State boards of health?

You're saying private businesses have no expectation to private property rights, which in my opinion is far from the truth. No one has to go to a restaurant or bar, and no one is forced to work at one. If you don't like it, don't go. Whatever you do don't get the state legislature breathing down business owner's neck.
