In the eleventh hour of his administration Davis furiously signed many bills into law that will have disastrous consequences for California families.
The last day for Davis to sign or veto legislation was Sunday, October 12. The following bill summary is our final legislative report for 2003.
Preventing Harassment by Non-Employees (AB 76) - Employers will be required to prevent "harassment" of their employees, not only by other employees, but by non-employees as well. This bill exposes employers to greater liability and forces them to "take sides" with their employee in a spat between the employee and a customer. Signed by Gray Davis on 10/3/03.
Gay Marriage (AB 205) - Registered domestic partners will have all the rights and legal protections given to a spouse. This is simply "gay marriage" by another name. Signed by Gray Davis on 9/19/03.
Indoctrination of Religious Foster Parents (AB 458) - Foster parents will be required to go through "sensitivity" training and support homosexual, bisexual and transsexual behavior and expression among their foster children. A foster parent will not be allowed to say anything to oppose a foster child who decides to change his/her gender. This is an attempt to indoctrinate religious foster parents and exclude them from the system altogether. Signed by Gray Davis on 9/10/03.
Mandating Health Care for Employees (SB 2) - Employers that employ at least 20 persons will be required to provide health care coverage to all employees. This bill will drive businesses from California and will result in further unemployment problems. Signed by Gray Davis on 10/5/03.
Drivers Licenses for Illegal Aliens (SB 60) - Illegal aliens may now receive drivers licenses in spite of their unlawful entrance to this country. Driving in California is a privilege. Illegal residents should not be given "goodies" by the government. SB 60 encourages illegal behavior and compromises the security and safety of California families. Signed by Gray Davis on 9/5/03.
Radical New Sex Ed Program (SB 71) - A radical new sex education program will now be implemented for public school children in California. Children will be encouraged to embrace the homosexual lifestyle, will be given less instruction on things like abstinence, and parents will not be notified every time their kids are studying sexual content in the classroom. Review Board for Destruction of Human Life (SB 322) - A review board will be established to approve stem cell research projects. Human embryonic stem cell research is the destruction of human life. This is a defeat for those who believe in the sanctity of human life. Signed by Gray Davis on 9/24/03.
Emergency Contraception with No Prescription (SB 490) - A pharmacist will now be able to furnish emergency contraceptive drugs (like RU-486 which recently caused the death of a teenage girl) without a prescription. Signed by Gray Davis on 10/1/03.
Less Training and Guidelines for Releasing Emergency Contraception (SB 545) - Training requirements will now be removed for the limited purpose of allowing a pharmacist to use his own discretion in administering emergency contraception, with no specific guidelines. Signed by Gray Davis on 10/1/03.
Storing Human Life for Destruction (SB 771) - A repository for embryos will be establish so that scientists may more easily access the embryos for stem cell research. SB 771 authorizes human life to be stored in containers to await destruction (death) in the name of "research." Signed by Gray Davis on 9/24/03.
The following bills were not signed or vetoed by Davis and will automatically become law.
Special Contracting Rights for Homosexuals (AB 17) - State agencies will be prohibited from entering into contracts for the acquisition of goods or services with a vendor or contractor that does not offer domestic partner benefits equal to benefits offered to spouses. AB 17 forces businesses, including non-profits like Salvation Army, to embrace homosexual marriage, if they want to do business with the state.
Death Benefits to Domestic Partners (SB 85) - Existing law provides that, in certain counties, death benefits may be given to a domestic partner provided that dependent children of the deceased are given first priority in receiving the death benefits. SB 85 lowers the age of dependent children from 18 to 17 to give broader powers to the deceased in giving death benefits to domestic partners.
Extension of Medicinal Marijuana Research Program (SB 295) - Existing law provides for a 3-year program to develop and conduct studies on the medicinal use of marijuana. SB 295 deleted the 3-year duration limit so that the program extends indefinitely.
Medical Marijuana ID Card (SB 420) - ID cards are now authorized for obtaining "medical" marijuana - despite the federal law against cultivating and possessing the substance. This legislation is deceptive in its attempt to legalize the use of marijuana.
Silencing the Free Speech of Students and Teachers (SB 719) - Under the guise of seeking to reduce "discrimination and harassment on campus, SB 719 prohibits the free speech of teachers and students who disagree with the homosexual and transsexual lifestyles. In addition to violating free speech rights, this bill is unnecessary because schools already have comprehensive safety plans.
Encouraging Illegal Drug Use (SB 774) - Pharmacists are now permitted to sell up to 30 hypodermic needles or syringes, at a time, to anyone. Pharmacists also, now, are no longer required to document information about persons who purchase the needles or syringes without prescription. Additionally, persons who possess up to 30 needles will no longer be classified as "possessing drug paraphernalia" for purposes of law enforcement. Thus, this bill encourages continued illegal drug use and makes it harder for law enforcement to convict illegal drug users. SB 774 could also potentially increase the amount of contaminated needles and syringes left in parks, beaches and other public areas.
