Trump Backers File 'Birther' Lawsuit Against Ted Cruz

Supporters of Republican presidential candidate Donald Trump have filed a federal lawsuit challenging the eligibility of Texas Sen. Ted Cruz (R) to run for president.

The suit, filed in federal court in Alabama, alleges that Cruz is not a "natural born citizen" of the United States, and should therefore be disqualified from seeking the office of president.

Cruz was born in Canada in 1970 to an American mother.

The plaintiffs, Sebastian Green, Shannon Duncan, Kathryn Spears, Kyle Spears and Jerry Parker, are all residents of Cullman County and supporters of Cruz's opponent, Donald Trump, according to AL.com....

Cullman County, AL. County seat= Cullman,AL. Home to Hank Williams, JR with a LOT of friends there (and can assure you they aren’t and he isn’t a trump supporter— on guns alone), and who says about the 2016 election— “I don’t give a s....” Meanwhile, Merle Haggard says he thinks trump is “dealing from a strange deck”.

Other “stars”— Like Kid Rock (good Lord!) and Loretta Lynn both support trump. What does that tell you? Huge disconnect, as it is a looooong way from Kid Rock to Loretta Lynn. Jersey potty mouth nothing nasty all the way to a survivor of Coal Country. On the other hand— can recall hearing radio commercials for obamaumao done by Ralph Stanley (bluegrass legend)— selling out WV Kentucky and VA coal miners— now all out of work. Pays to pimp.

Could be a really good thing for Cruz to get this issue adjudicated. Right now, the average voter probably has some doubts about it.

It is assumed that it is “Trump Backers” filing this “suit” .

It is not— the suit, which you can find the full text filing of online, is being brought with these people’s names on it. The lawyer bringing the suit, filing it... is a longtime MACHINE Democrat in AL.

Thomas E. Drake II Atty in Cullman, AL. Retired from AL House of Representatives... life long Democrat.

Short bio: “Tom Drake served nine terms in the Alabama House of Representatives, two of which he was Speaker of the House, elected by the entire body of the House. For eight years he served as chairman of the powerful Rules Committee, as well as other committees, and as floor leader for Govs. George Wallace, Lurleen Wallace, Albert Brewer, Fob James, Guy Hunt and Jim Folsom.

Tom retired from the House of Representative in 1998”

This floor leader reads like a who’s who of AL... well... race politics. It’s the Democrats, FReepers. Not trump-— at least not yet.

The filing atty— Thomas E. Drake, II has a Coliseum named after him (or his daddy) Tom Drake Coliseum on the campus of Wallace Community College in Cullman, AL. Wallace CC named after Gov. George Wallace.

You are aware that the Constitution does NOT vest the authority for the determination of the rules of naturalization SCOTUS, right? That authority is specifically enumerated to Congress.

You are either a natural born citizen or naturalized.

Cruz owes his citizenship to naturalization (via an Act of Congress).

Therefore, he’s not a NBC.

Therefore, he’s ineligible.

That’s why Obama’s birth location mattered to much. Not only was Obama not a NBC if born out of the country, he likely was not a citizen of the U.S. at birth because he couldn’t attain it via his mother (Hawaii was a new state at the time and she hadn’t lived in a state the requisite time).

It mattered with Obama.

It matters now with Cruz and with Rubio.

No NBC = no presidency.

He can, however, be appointed to SCOTUS.

Sorry but you are incorrect. Cruz’s citizenship is from the circumstances of his birth. In the Constitution, Article 1 Section 8 enumerates Congress to establish ALL of the rules of naturalization. That includes:

- who is a citizen at birth (naturally born)
- who can apply for naturalization
- who can never be naturalized
- what is the process for naturalization
etc

Congress’ will in this mater can be found in U.S.C. Title 8 Section 1401 - Citizen at birth. Those that are born on US soil (jus soli via 14th amendment) are covered under subsection A of that code. Sen Cruz, via the citizenship of his mother, per sub section G, was born a citizen of the US and thus is a NBC.

I don’t think it maters whether it proceeds or not. It still places those seeds of doubt in undecided voters. The damage is done. Like the old “when did you stop beating your wife”. I wish McConnel would have put this to rest instead of saying:

“I just don’t think the Senate ought to get into the middle of this, These guys will all slug it out in Iowa and New Hampshire. We’ll have a nominee hopefully by sometime in the spring.”

What the heck do you have to do to be born a Canadian citizen?... does it require two Canadian citizens and born in Canada?

Because if you have an American mother and a Canadian father and your born in Canada and you’re still become an American citizen and not Canadian..

Then if you had an the same American mother and a Canadian father but you were born in the United States ...do you become a Canadian citizen?

At best Cruz has to be considered a dual citizen

You should ask the Admin to modify the headline to reflect that the suit wasn’t filled by backers of Trump, but by a former Democrat Alabama legislator.

That’s not true. The people who brought the suit are self-described Trump supporters. They could use Alan Dershowitz as their lawyer and they’d still be Trump people.
