Yep, that is a real threat, and it's personal. I received such a threat once, and am grateful I got the police involved. Sorry - but the court is right to rule that if it was sent by the accused, the sender acted criminally (and made a record of it.)

Threatening to engage in legal activity is protected speech, especially in the case of a public figure. There is no actionable threat here.
