If the business is open to the public, it's gonna be regulated. In California no smoking is allowed where members of the general public are present.
Private clubs are another matter.

Lacking proof of harm, why would the dissolution of a persons property rights , to allow a LEGAL commodity to be consumed in their place of business, be allowed?
