Davis Excuse in Pledge Case Proves Outright False
Simon Provides Certified Mail Receipts Showing Davis Ignorance Claims Unfounded
RIVERSIDE - Governor Gray Davis' excuse regarding his failure to entered a defense in the recent Pledge of Allegiance lawsuit has proved outright false, gubernatorial candidate Bill Simon told a gathering of business leaders today.
On Thursday, after Simon blasted the governor for his failure to submit a legal defense on behalf of the state, Davis responded by saying he had not entered a defense because neither he nor Attorney General Bill Lockyer had been notified that the state was a defendant in the lawsuit, and quickly paraded the announcement that he would now submit a defense. But on March 8, 2000, the same day that Michael Newdow filed his court case challenging the Pledge of Allegiance, a summons to appear in court was sent by certified mail to Lockyer at the Department of Justice address advertised on his Web site, records show. The plaintiff, Newdow, filed on March 10, 2000 with the Eastern District Court in Sacramento the receipt of certified mail showing proof of service to Lockyer's office. On April 26, 2000, Newdow filed with the court clerk proof of receipt showing that the attorney general's office had received the service.
"Gray Davis now claims neither he nor his attorney general were served papers about the lawsuit," Simon said in remarks to the Riverside Lincoln Club. "But the U. S. Government, in courthouse documents and through certified mail, tells a different story. The plaintiff of the case is in possession of proof of service, demonstrating that the governor's lawyer, Bill Lockyer, did receive notice. The fact of the matter is that once again our governor is resorting to half-truths and deflection in order to mask his failure to act."
"Gray Davis' failures as governor continue to accumulate with each day he is in office," Simon said. "He failed to act in the energy crisis, in the budget crisis, to prevent offshore oil drilling, on the needs of California veterans, and now it is clear the governor failed to act in defending the Pledge of Allegiance. This list goes on and on. California just cannot afford this kind of failure."

No, in fact being a certified liar might help assure Davis of a bright future in the Democrat party.
Being a world class liar and exposed as such did not hurt the status of the Bent One, the Clintoon in the Rat Party. It seemed like every scandal made the Clintoon or his Hildebeast even more of a hero to the Rats!
Oil, tar, and natural gas have been seeping into the Santa Barbara Channel at least since the latest low sea level mark, approximately 20,000 years ago, at the height of the last ice age. At that time, many of the oil-bearing formations were exposed to erosion at the earth's surface, around the edge of the Santa Barbara - Ventura geologic basin. Today, those erosional surfaces are still exposed or covered with a thin layer of sedimentation. Thousands of those seeps are active all over the basin, some now covered by rising sea level (about 350-400 feet in the last 20,000 years).
You can still hear the aged, hippy, eco-Nazis and their Hollywood socialist collaborators complain about the leaking oil production platforms. But the fact of the matter is, the operations in the Santa Barbara Channel have been the cleanest and safest in the world since 1969 (when the regulations were changed after the oil spill there). The natural seepage (on the order of 100-150 barrels per day) dwarfs the level of accidental spillage. The oil in runoff from the streets of Los Angeles after a heavy rain dwarfs the natural level of seepage for the same time period.
Yes, they'll claim that the low-level flunky who signed for the summons forgot to pass it along. They'll fire said flunky with a nice under the table payment, and get back to politics as usual.
Either the secretary or the mail-room clerk will get fired for failing to pass on the documents. "I didn't know that!"

I'm not so sure about this one. The California media has been hard on Davis. While not attacking him outright, they have not been suppressing unfavorable news about him the way the national media protected Clinton.
For Davis to blame this on lower level staff, he'd be setting up Lockyer as the fall guy. Lockyer was the guy who wanted to put Kenneth Lay in a cell with a guy named Spike, remember?
No, this issue is just plain incompetence, arrogance, or inattention. The media can't hide this when the whole nation is talking about it.

He isn't, except for the one Field Poll. Every other one that I've heard of has the race dead even or Simon having a slight edge. You can tell that Davis thinks he's behind, given the big TV ad buy he's done to bash Simon.
