Interpretation of law allows confiscation

CUMBERLAND -- Under the current interpretation by the Maryland attorney general concerning the confiscation of firearms, citizens who had misdemeanor transgressions at any time in the past could have their guns taken, according to Delegate Kevin Kelly.

Such misdemeanors include cheating, defamation of private persons, unlawful assembly, blasphemy, profanity, common scolding, disturbance and disorderly conduct.

"As long as a person could have been sentenced to one year or more in jail, their guns can be confiscated," Kelly said.

"If you actually spent more than a year in jail then you did something bad and I don't want you to have a gun either. But like in Larry's (Dicken) case, two young bucks got into a shoving match and he has been law-abiding ever since then. He should be allowed to have his firearms."

Dicken said he didn't even use guns until after his son graduated from high school in 1998 and he found himself needing something to do.

"My brother hunted and I got into it that way and found that I enjoyed shooting and hunting," Dicken said.

Kelly said his fellow legislators tell similar stories involving their constituents elsewhere in Maryland. His request in October for state police to quantify such confiscations and explain the individual convictions upon which actions were based has gone unanswered.

He is sponsoring a bill that would prevent state officials from enforcing the federal statute that allows confiscation of the weapons. It also would prohibit anyone who was sentenced to a year or more in jail from owning or possessing a gun.

"I'm hopeful that the bill will pass and that I will be able to use the firearms again," Dicken said. "At first I was so upset that I brought in my American flag from out front. I felt like I didn't have any freedom anymore. Then Sept. 11 came and everybody everywhere was buying guns to protect themselves, but I wasn't allowed to protect myself. Now, I've got $5,000 worth of guns I can't use and I paid for a membership at the Fort Hill Rifle Club and I can't shoot. I hope it works out. I really want to go hunting next year."

Standard response #1405.23(a): We elect them, so the way we 'confiscate' their power is to vote them out of office. This keeps the sheep happy enough, and let's them pretend they aren't be led to slaughter. What's your alternative?

Sad to say, but I'm convinced that people will sit by and let "other people" elect the kind of opportunists that will legislate us into insanity, so long as they've got an uninterrupted stream of bread and circuses. It's a time-proven "management technique".

If you want to see fighting in the streets, organize the sitcom "actors", Big Three sports industries (base/foot/basket ball), and breweries to go on strike, then run like hell so you don't get caught up in the madness that will certainly ensue.

And by the same token, if you want to see "1984 Meets Brazil", just sit back and watch, because like it or not, that's what we're getting, IMO.

Who would have guessed that the Monty Python crew would be the prophets of the age? :)

It's not quite that simple. There are also plenty of people on this forum who elevate McVeigh to sainthood and see the OKC bombing as something akin to a religious sacrament.

And the ugly truth is that those folks give "the great unwashed" a strong incentive to shrug their shoulders as more and more anti-Second Amendment laws are passed, because frankly, they see it in terms of reigning in home-grown terrorists like McVeigh.

What McVeigh did was wrong and he was punished for it. What the Federal Gestapo did at Waco was equally wrong and, unfortunately, they were not punished for it nor will they ever be punished for it. What is wrong for an individual is also wrong for the state. If it was evil for McVeigh to kill a bunch of people in an unprovoked attack, then it was evil for the FBI to kill a bunch of people in an unprovoked attack. McVeigh paid the price for murder. So should every agent and supervisor who was responsible for the Waco atrocity.

McVeigh and his ilk are not a threat to America. Unrestrained government is the worst threat we face. It has almost destroyed what was once a great country, and if allowed to continue unchecked will leave us with a tyranny that Stalin and Hitler would be proud of.

There is no left or right, there is right and wrong, and unless we begin to see it that way, and vote accordingly, we will lose. Neither side really believes in the flowery vomit they spew, it is just designed to get the blood riled up, and scare us enough to vote the way they intend, or turn off, they could care less which it is. They have the hard core Kool-Aid drinkers in each party, and the ignorant, who they try to sway every 2/4 years. The people that follow politics, that are truly independent minded, are the target for massive scare tactics, designed to keep them in the fold, or force them to choose between Satan or the Angels, all depending on which side you lean towards.

I can't think of an example in history of suburban neighbors behaving the way you suggest.

They would only get 50 times more gestapo in response to deal ever more harshly with them all, up to the Waco treatment.
