December 8, 2001 -- The national embarrassment known as Mary Frances Berry, chairwoman of the U.S. Civil Rights Commission, has outdone herself.
Yesterday, Cleveland labor lawyer Peter Kirsanow was sworn in to replace commission member Victoria Wilson. But Berry refuses to recognize Kirsanow; she won't even let any other commission member refer to him as "commissioner."

she is APPOINTED! not elected she can be UNAPPOINTED = FIRED any time.
But get this -- Miss Berry will argue that her commission's role as 'watchdog' or 'overseer' inherently grants her independence and insulation from political interference, therefore creating a kind of quasi-independent branch, akin to the Federal-judiciary.
Really -- that's her position -- that the founders THOUGHT there were three branches of governemtn, but there are really FOUR -- and she's the fourth!!

Sec. 1975. Establishment of Commission
- (a) Generally
There is established the United States Commission on Civil Rights (hereinafter in this chapter referred to as the ''Commission'').
- (b) Membership
The Commission shall be composed of 8 members. Not more than 4 of the members shall at any one time be of the same political party. The initial membership of the Commission shall be the members of the United States Commission on Civil Rights on September 30, 1994. Thereafter vacancies in the membership of the Commission shall continue to be appointed as follows:
- (1) 4 members of the Commission shall be appointed by the
President.
- (2) 2 members of the Commission shall be appointed by the
President pro tempore of the Senate, upon the recommendations of
the majority leader and the minority leader, and of the members
appointed not more than one shall be appointed from the same
political party.
- (3) 2 members of the Commission shall be appointed by the
Speaker of the House of Representatives upon the recommendations
of the majority leader and the minority leader, and of the
members appointed not more than one shall be appointed from the
same political party.
- (c) Terms
The term of office of each member of the Commission shall be 6 years. The term of each member of the Commission in the initial membership of the Commission shall expire on the date such term would have expired as of September 30, 1994.
- (d) Chairperson
- (1) Except as provided in paragraphs (2) and (3), the individuals serving as Chairperson and Vice Chairperson of the United States Commission on Civil Rights on September 30, 1994 shall initially fill those roles on the Commission.
- (2) Thereafter the President may, with the concurrence of a majority of the Commission's members, designate a Chairperson or Vice Chairperson, as the case may be, from among the Commission's members.
- (3) The President shall, with the concurrence of a majority of the Commission's members, fill a vacancy by designating a Chairperson or Vice Chairperson, as the case may be, from among the Commission's members.
- (4) The Vice Chairperson shall act in place of the Chairperson in the absence of the Chairperson.
- (e) Removal of members
The President may remove a member of the Commission only for neglect of duty or malfeasance in office.
- (f) Quorum
5 members of the Commission constitute a quorum of the Commission

This is a party (Democratic) that is running out of ideas. They are pathetic in a patriotic war environment and they are realizing that even with almost 100% African American support they are really getting out of touch with mainstream America. Their other contingents consist of angry divorced mothers and gays and, thus, you have a patchwork mess that is adrift. And boy am I loving it.

this little crisis is an obvious contrivance of an increasingly desperate Democrat PartyI agree! They really NEED an issue, don't they? After all, their little ambush of Ashcroft this week didn't quite turn out like they thought it would.
I think OUR issue should be to make a list of ALL of the legislation that ONE MAN, Little Tommy Daschle, has bottled up in the Senate; one man is stopping the economy and oil drilling, plus a LOT of other stuff. I wish I had made of list of every piece of legislation he has said "we won't be able to get to that until next year" about!

This so called civil rights commission has become a joke and a disgrace. It is all about leftist socialist propaganda, an arm of the DNC, not about Civil Rights at all.

And.. .Berry and her black yes man yesterday came right out and said Bush is doing this because of their (the 4 Berry tag team that is)Flordia report criticizing GW and Jeb. The letter sent by Conyers and Nadler said the same thing. They have they're talking points and will try to get as much mud slinging out of this they can. Just wait, we will be hearing much more about Florida and the Dims will line up (just like they always do)a to trash the conservative threat.
