A dying man has been awarded more than $500,000 in damages in a landmark case involving the Catholic Church.
The Catholic Diocese of Maitland-Newcastle was found to be directly and vicariously liable for the man's abuse at the hands of a priest who taught scripture 55 years ago.
The man, who for legal reasons can only be referred to as AA, alleged he was abused by Father Ron Pickin at Wallsend High School in the Hunter Valley.
Father Pickin died in 2015.
In a judgement published this week, Acting Supreme Court Justice Monika Schmidt said AA left school in year 10 and "had a difficult life afterwards".
The court heard he was "unable to tell anyone about the abuse, not trusting anyone despite thoughts of the abuse and resulting anxiety having troubled him his whole life".
AA sought damages and was represented by the Sydney law firm Koffels.
“AA is a landmark case in New South Wales, as the first judgement where the courts have found a diocese both negligent and vicariously liable for sexual abuse committed by a Catholic priest," managing counsel Aaron Koffel said.
The court was told Father Pickin attended the high school to provide religious scripture classes.
AA's legal team argued it was a case of vicarious liability and that the diocese should be held legally responsible for Father Pickin's alleged acts because he was employed by it.
'Access to children'
The diocese denied vicarious liability for the alleged abuse, which it said did not take place, and argued about what constituted employment.
It argued Father Pickin was not an employee and that "it had not placed him in a position akin to employment, or in any position of power, control or authority over AA".

Nevertheless, the Times followed through with the story and found that the molestation claims involved approximately 2.5% of the 100,000 ordained priests in America (or 2500) over a 50 yr time span with an average of 3-5 victims per priest. Over 85% of the victims were adolescent boys, which means the priests weren’t actually pedophiles and instead were homosexuals. Of course, they refused to reach that common sense conclusion and continued to spread misinformation by salaciously implying they were molesting little kids.
With your comment, you’re perpetuating the myth that all priests are molesters when in fact 97.5% of Catholic priests are good and holy men in an often thankless job. There is also credible reporting that 10% of Protestant clergymen and 10% of educators have also engaged in abusing the children/youth in their care, so evil exists in all walks of life.
It seems to me that ebbtide isn’t spamming anyone. He’s merely presenting contrasting material to show that child molestation occurs in all denominations. Otherwise ppl are left with the impression that only Catholic priests are engaging in it which simply isn’t true.

This legal template can be used to destroy leftist government schools throughout the western world. Dangle multi-million dollar jackpots, and the abuse victims will come out of the woodwork. Government schools are specially protected from this style lawfare, so step one is remove their unequal protections, especially from their pensions. The ones who do tend to wait a long time until they can process things as an adult. As such, it is a safe assumption that reported molestation is the tip of a never seen iceberg of priest child molesters.
