In Maymulakhin & Markiv v. Ukraine, (ECHR, June 1, 2023), the European Court of Human Rights in a Chamber Judgment held that Ukraine violated Article 14 (prohibition of discrimination) of the European Convention on Human Rights taken in conjunction with Article 8 (right to respect for private and family life) by denying any form of legal recognition to same-sex couples. The Court said in part:
While the Court has to date not interpreted Article 8 of the Convention as imposing a positive obligation on the States Parties to make marriage available to same-sex couples, it has confirmed that in accordance with their positive obligations under that provision, the member States are required to provide a legal framework allowing same‑sex couples to be granted adequate recognition and protection of their relationship.... The Court has also held that Contracting States enjoy a more extensive margin of appreciation in determining the exact nature of the legal regime to be made available to same sex couples....
The Court ordered Ukraine to pay the two petitioners 5032 Euros each as damages and to pay 4000 Euros for costs and attorney's fees.

The USA is totally obsessed with acting as if civil marriage and religious marriage being THE EXACT SAME THING.
The whole European setup separates them, and “marriage” in the Euro context is an umbrella term for all kinds of civil and religious unions between 2 consenting adults.
It’s why in the UK “civil partnership” (really shorthand for extending the legal bidirectional contracts implied by tradition marriage, to any couple wanting the same kind of legal contract but who WEREN’T getting married) was ALSO called “gay marriage” despite it being “not a marriage, but a legal status similar to marriage”.
Ukraine’s got busted not for being Globohomo or not bring Globohomo enough... It’s got busted for not differentiating between civil partnership unions and religious partnership unions in the correct way.

That’s even explained in the quotes at the top of this thread.
At the bottom it clearly says participating states have considerable latitude on what their “not religious marriage” marriages can be but the legal concept that any two consenting adults can have a civil partnership akin to the one that exists for traditional marriage, for any reason.
If two spinster sisters want to completely codify their lifelong reciprocal inheritance rights, rights of attorney, duties of care, and legal duties in a legal framework, why piss about creating a four thousand pages of one-off contract when “it’s basically the same as they’d be signing up to in a traditional marriage” would explain it just as easily?
If two gays want to do the same as the spinster couple, and the legal framework exists to do it, why shouldn’t they be able to use it?
Don’t get me wrong, I’m in a traditional marriage but “render unto Caesar” applies. God knows the difference between His ordained union of man and woman, and a temporal contract between two consenting adults.
