Kentucky Judge Dismisses Life at Conception as a ‘Christian and Catholic Belief’

A circuit judge in Kentucky has again blocked a pair of state abortion bans from taking effect — in part, he said, because they adopt “a distinctly Christian and Catholic belief” about when life begins.

“The laws at issue here adopt the view embraced by some, but not all, religious traditions, that life begins at the moment of conception,” Judge Mitch Perry of the Jefferson County Circuit Court wrote in an opinion issued Friday.

“The General Assembly is not permitted to single out and endorse the doctrine of a favored faith for preferred treatment. By taking this approach, the bans fail to account for the diverse religious views of many Kentuckians whose faith leads them to take very different views of when life begins,” he said.

“There is nothing in our laws or history that allows for such theocratic based policymaking,” he added.

At issue are two laws Kentucky’s General Assembly passed in 2019. One is a six-week abortion ban, and the other a “trigger” law that would ban virtually all abortions in the state in the event the U.S. Supreme Court overturned Roe v. Wade. That happened on June 24, clearing the way for states to regulate abortion as they see fit.

Neither Kentucky law makes exceptions for rape or incest, Perry noted.

The plaintiffs in the case — two abortion clinics and an abortionist who owns one of the facilities — maintain the state laws are unconstitutional. They have asked Perry to issue a temporary restraining order to stop them from being enforced until the case is fully resolved in court.

Perry issued a stay June 29 and another one Friday.

Yes it is a religious belief but the science is sound - the process of birth, life, begins at conception.

This is a completely spurious decision based on nothing other than the judge’s anti Christian position. By this logic any law that is supportable by Christian faith is a theistic imposition. Completely insane.

This judge has a bias towards Christianity in general and Catholicism in particular. That’s clear, because there are other faiths and dogma that hold the same view as Christians and Catholics.

The way to throw that back at the judge is to say, “Okay; if life does not begin at the moment of conception, it necessarily must begin the moment after, as that is when cells begin to reproduce.”

I posted this many years ago ...

At the moment of conception a new being comes into existence with the characteristic of constantly replicating its own cells according to the coding of its DNA. It has unique DNA that, with the exception of identical twins, no other being has ever or will ever again have. Those are defining characteristics of a discrete living being. Its DNA is specifically human which categorically makes it a living human being.

The question of whether it has a spirit, a soul or a mind may not be possible to answer with science but science does answer, without equivocation, that it is an individual living human being from the moment of conception or at least very shortly after when the two half-strands of DNA combine.

Our pastor just did a sermon on “When does life begin” in response to questions submitted to him. He said science says that life begins at conception and is acknowledge by almost everyone.

The real question is, when does the combined cells become a person. He said that only the Judaeo/Christian religion calls it a person at conception. All of the other religions have it at some later date.

I just looked it up for Islam - and found some site where they figure from the Quran that it isn’t a person (with a soul) until 120 days after conception. Prior to that it is a clump of cells.

“Each one of you is constituted in the womb of the mother for forty days, and then he becomes a clot of thick blood for a similar period, and then a piece of flesh for a similar period. Then God sends an angel who is ordered to write four things. He is ordered to write down his deeds, his livelihood, the date of his death, and whether he will be blessed or wretched. Then the soul is breathed into him…” (Sahih al-Bukhari: 3036).

I’ll take his word on what the other religions say it is.
