Archdiocese of Indianapolis Faces New Lawsuit Over Same-Sex Marriage School Policy

An Indiana guidance counselor has filed a lawsuit against an Indianapolis Catholic school which placed her on administrative leave after she contracted a same-sex marriage, and did not renew her contract when it expired.

Shelly Fitzgerald, who worked at Roncalli High School for 15 years, filed suit in federal court on Monday against the Archdiocese of Indianapolis and the high school.

Fitzgerald civilly married another woman in 2014.

According to the Indianapolis Star, after her civil marriage was brought to the school’s attention, Fitzgerald was asked to resign of her own accord, dissolve the civil marriage, or to maintain discretion about the situation until her contract expired.

When she refused these options, she was placed on administrative leave at the beginning of the last school year, and remained on leave until her employment contract expired.

Fitzgerald claims the decision was discriminatory. She is seeking damages for emotional distress and the loss of wages.

David Page, Fitzgerald’s lawyer, argued in the lawsuit that his client was treated differently than heterosexual employees who have disobeyed other Catholic teachings.

And how would he know this? And so what? The school is free to apply its own standards regarding conduct that is contrary to Catholic teaching. Not all such conduct is necessarily grounds for dismissal. It also depends on what position the employees hold.

If there were Catholics on the staff of the school openly in vbiolation of Catholic dogma, doctrine, and moral teaching, say having an abortion, a heterosexual living with another in an unmarried relationship, openly lax about following the requirements of the Faith, Mass on Sunday, they should be dismissed. If the school because of need, hires a non Catholic that person should be made aware that while not required to follow Catholic religious belief, Catholic moral precepts must be followed.

How can someone that’s screwed up be hired as a guidance counselor for youths?

At a different Catholic High School, in a nearby state, I know personally of a teacher that found out his girlfriend was pregnant with his child. Even though they got married, after the child was born, he was asked to resign because he was in violation of the agreement, which is nearly the same as the one here locally. He did so, and he didn’t file suit. Everyone knew why it happened. He was a good guy and a good teacher, however, his behavior WAS at odds with his contract. He didn’t hold up his side of his obligation. It’s always the LGBT ones who sue.

I taught 13 years in three Catholic schoolds in Brooklyn, the Bronx, and Queens. At the time I was not a regular at Sunday Mass but there was no way my prinvipal and pastor of the parish school would know that. The pastor of my first school would have asked me to resign had he known. I kept up with the Sunday readings so I could discuss them in class. When I taught in a regional Catholic HS in Queens there were two open homosexuals, that is they admitted to being gay but not to acting on their desires. The staff also consisted of many Catholic social action types who looked at me as if I were Gerry Ford, who accepted their colleagues.

Never attempted to fool God, but never mailed in a religion class. Always gave the kids 100%. Friends on FB with many. In awe of how many are fully invested in The Faith. More than 30 came to my wife’s wake, they had had her too. And these kids are in their 50s and grandparentz now.
