Gov. Gary Herbert on Tuesday signed a bill that keeps polygamy a felony in Utah and increases the penalties for polygamists convicted of committing frauds and abuses.
Herbert's approval of HB99 affirms the position Utah has held since statehood — that polygamy is against the law. Yet it's unclear how much of the bill will ever be used.
Polygamists and some sympathetic attorneys have said HB99 will be unconstitutional if it's applied to consenting adults who choose to live as such a family. Joe Darger, who has three wives and was the most vocal opponent of the bill, has dared prosecutors to charge him.
Darger doesn't think that will happen. After Herbert signed the bill Tuesday, Darger said the goal of HB99 appeared to be to keep polygamists silent by making their lifestyles a crime.
"This is more for persecution than it ever is intended for prosecution," the polygamist said.
The Utah attorney general's office and every county attorney who has been asked has said his or her policies are not to prosecute families like the Dargers. Assistant Attorney General Parker Douglas testified to the Legislature that prosecutors are concerned with polygamists who commit fraud and abuse.

They’ve passed a law that calls the founder of their religion a liar. Note the LDS church no longer teaches polygamy but the church has never said it’s wrong.

Does it matter? The Feds for the moment don’t allow it. That won’t last since he same argument for gay “marriage” apply to polygamy, polyandry and incest.

If you can change the long-accepted 'one man, one woman' to 'any two people,' I don't see why the number can't be changed as well.

One Mormon told me that the church has no rule against polygamy, but they do say Mormons should obey the law, so since it’s illegal here they can’t do it here.

Why should polygamy be illegal?
Strange that we make polygamy illegal, yet have no legal qualms about all the children born to poverty via the “baby-daddy” part of our culture. Seems to me that if polygamist can support their family, don’t go on the dole....where is the victim? We pretty much know where the victim is for the family where there is no father figure....
Polygamy & the “Baby daddy” culture are the same thing.
Lazy, horny, selfish men “marry” multiple women so they can have multiple women support him & do all the house & yard work while he sits on his ass. His entire life revolves around sex because unlimited sex is the sole reason for polygamy.
Just like “baby daddies “ the “father” ignores & neglects his children & they rarely see him.
Of course, in the cults like the FLDS, no one works & they sponge off the government. Pedophilia is rampant.
Actually, in a “baby daddy” scenario, the women are better off than they are in polygamy. At least, the women live apart & aren’t forced to share a home with other women whom they hate. And they’re not forced to support the baby-daddy, unlike polygamy.
In polygamy, the women are expected to live with each other, which is cruel. Naturally, the wives hate each other & suffer intense jealousy.
If polygamy is ever legalized, polyandry must be legalized too. If men can have multiple spouses, so can women. Correct?
I’m still waiting for someone to show me that polygamy is against the law of God. While I do think that any man that wants more than one wife is completely insane that’s not the point.
How many wives did Abraham have, and what was his standing before God as recorded in the Old Testament? And his grandson Jacob, whose name was changed by God to be "Israel," the father of the 12 Tribes of Israel - same question...
