Ohio Teacher Says She Was Fired Over Pregnancy, Files Suit Against Catholic Archdiocese

DAYTON, Ohio — An unmarried Catholic school teacher who said she was fired after telling her principal that she was pregnant is suing the Roman Catholic Archdiocese of Cincinnati.

It's the second lawsuit that's been filed in the last two years against archdiocese over the firing of a pregnant teacher.

Kathleen Quinlan, who taught first grade at Ascension Catholic School in Kettering in suburban Dayton, said she was told to resign or she would be fired, on the same day she told the school's principal in December 2011 that she was expecting. She said she had offered to take a behind-the-scenes job until she gave birth.

Quinlan, of Dayton, who later had twin girls, said in her lawsuit that she was given three days to clear out her classroom.

A termination letter said she was fired for violating a section of her employment contract that requires employees to "comply with and act consistently in accordance with the stated philosophy and teachings of the Roman Catholic Church," according to the lawsuit filed in U.S. District Court .

Her attorney said that, "as a non-ministerial employee, (she) was not subject to a 'morality clause.'"

I’m almost certain it is against the law to fire a woman for being pregnant, no matter who you are.

because the first consideration was not to have teachers who set bad examples for the kids to imitate.

That's a big issue, but another is that teachers in a Catholic school should believe the Catholic Faith and accept Catholic moral teaching. This doesn't mean never sinning ... I myself holler, "Bleep bleep bleep FREEEEEEP!" more often than anyone should, and I'm excessively fond of wine ... but it doest mean correctly identifying sin, and that includes fornication and contraception.

Independent of all other factors, the presence in a Catholic school of a teacher who is pregnant outside marriage creates a climate of "Don't judge her choices!!! At least she didn't have an abortion !!!" We already have plenty of "Don't judge," taking precedence over accurately teaching Catholic Faith and morals, because of the family situations of students both Catholic and non-Catholic.

She is not being fired for her pregnancy. She is being fired for not being married while pregnant.

I knew a woman who worked for a Catholic diocese (non-teaching job, but worked directly for the bishop) who was fired for publicly promoting contraception.

No it means being vocal and outspoken in your opposition to the direct moral teachings of the Catholic Church.

Try going to your place of employment and being in your face as you flaunt the rules of your work place and let's see how long you last in your position. Unless you are self employed or work for the government you will be out on your ass in a New York minute.

The Catholic Schools teach and expect their paid employees to conduct themselves in a moral and upstanding manner. The teacher flaunted the rules, committed a mortal sin and expects to be patted on the head and told that everything is OK. Well, life doesn't work that way, they are not the Federal government, they are the Body of Christ. God has NO CUALMS about casting your soul into eternal damnation if you die outside of His Grace, I am sure he approves of the schools decision to hold this woman to e certain standard.

She is welcome to fight in the courts, but the Church, like with the HSA mandates, will refuse to comply.

Women do it all the time, they can't stop talking about it. Didn't you see the Democrat National Convention?

As for the women at issue. She became pregnant outside of wedlock. Becoming pregnant is not a sin. Sexual intercourse outside of marriage IS A MORTAL SIN in the eyes of the Roman Catholic Church. There are very good reasons for this rule. It is covered thoroughly by the Church throughout millennium and especially well in the The Papal Encyclical ‘Humane Vitae’ By Pope Paul VI from July 25, 1968.

This Encyclical on Human Sexuality makes artificial birth control, abortifacients and abortion FOREVER grave sins for all of humanity. Particularly for those who are in the knowledge of Christ. It is not negotiable.

Feel free to read the entire English translation. It is available on the Vatican Website for free or can be purchased in hard copy at Amazon.com for less than $5.

If you disagree with the rules of the Church I suggest that you do not join, leave the Church for a less rigid denomination and/or refrain from taking a job with an organization underwritten by the Roman Catholic Church.

I am absolutely certain that it is not! She was not fired for being pregnant. She was fired for violating the terms of her contract. No different than if she had too many unexcused absences or was grossly insubordinate to her supervisor.

She is an at will employee under an employment contract. The contract contains a nonnegotiable morals clause requiring adherence to the rules of the Roman Catholic Church. She violated those rules by engaging in premarital sexual intercourse with a man. The byproduct of that immorality is a pregnancy.

The pregnancy makes the immoral behavior public knowledge. The public knowledge of her immoral behavior REQUIRES her to be released from employment. If she had been convicted of a crime like theft she would also have been released under the terms of her contract. Theft is an immoral act as well. So is public defiance of Church teachings. She willfully engaged in premarital sexual intercourse. She made that decision with all the knowledge that it was moral wrong, was against the teachings of the Church and violated the terms of her employment contract.

I certainly hope that the lawyer didn't take the case on retainer, he will never see a dime of a settlement. She will lose. The case should be dismissed with prejudice at the first hearing.

I can see that. How was she promoting it, to her friends outside of work or talking about it with the other employees? Surely not with the nuns!!

Yes. The fact that she became pregnant IS a fact that would be difficult to hide. That makes the flaunting of her defiance of her contract and the rules of the Catholic Church very public. It is unfortunate that she chose to engage in premarital sexual intercourse against both the rules of the Church and the terms of her contract, but she did so in the knowledge that it was both morally wrong AND against the moral clause of her contract.

The risky behavior that IS intrinsic with the sexual act should be enough for MOST people to be more responsible with their decision making, but responsible behavior is often hard to come by in society these days.

Regardless, the Church requires that their employees, particularly those who are involved directly in the education and moral instruction of children to adhere to those teachings in their private lives. They require that those employees sign a contract to that effect. She violated that contract and is subject to dismissal for cause. She was so dismissed.
