Chuck and Stephanie Fromm already have been fined $300 for holding Bible studies for their friends at their home, and they face the potential for additional fines of $500 for each study held, according to a legal team taking their case to court.
The newest conflict over Bible studies in homes in America arose in San Juan Capistrano, Calif., where city officials say city code section 9-3.301 prohibits religious organizations in residential neighborhoods without a conditional-use permit, a sometimes very expensive procedure.
The code cites "churches, temples, synagogues, monasteries, religious retreats, and other places of religious worship and other fraternal and community service organizations."

The right to peaceably assemble is associated with petitioning the government for redress of grievances. It doesn’t stand on it’s own.
I debated about going there and thought I'd limit my defense of freedom to the one religious based issue. To peaceably assemble is a right that applies to all Americans. All people for that matter. Thanks again.

So now the Bible Study needs to become an assembly to peaceably petition the Government for a redress of grievances, since it is clearly overstepping its bounds.
Actually, it better be able to stand on its own, otherwise you've just given the government blanket permission to prevent peaceable assembly for any other reason than the express purpose of petitioning the government for a redress of grievances.
Great point, wait until a mosque gets put in somewhere in the city and the call for prayer starts up a 5:30am every day.

Not a blanket permission, the government actor who imposes restrictions has to justify them. See parade permits, etc.
But there can be NO law, NONE, that stands between the people peaceably assembling (by the millions, if that's what it takes), for the purpose of petitioning the government for redress.
But this has nothing to do with Congress.
I’m not offically a Constitutional expert like Obama is. In my opinion, the right to peaceably assemble is separated from redress of grievances. But can be used in conjunction with each other or in an argumentative debate.

I don’t think that the constitution states a right to a parking space and really how much noise do a group of christians make during bible study.....geeze, its not the governments business, fed, state or local....Religion is not to be infringed on by petty town officials...

This looks to be more of a parking issue than a religion issue. The conditional-use bit addresses the effects of large numbers of vehicles and the impact that has on the local community (ie: whether roads need to be expanded to handle the new influx of traffic).
Which means the bible study probably had a large number of cars parked on the side of the road and in other home’s driveways.

This may point out a dillema - a conflcit between two rights. One right is the paractice of religion and freedom of religious expression. The other is the neighboring property owners rights to limit uses to those allowed by zoning which are compatible. It is the right to enjoy ones property without posing substantial injury to someone elses. Parking, traffic, noise etc can pose a burden on other property owners unless mitigated.Are the neighbors allowed to throw a beer-bash?
