PROVO -- A 19-year-old Cedar Hills man found guilty of two first-degree felony sex crimes will not be getting a new trial.
Sergey Tyler Millett was in court Friday as his attorneys debated new evidence that had arisen since his trial in April as well as the possibility of a new trial. The evidence seemed to indicate that the 15-year-old victim in the case was somehow coerced to give statements to the police regarding the relationship she'd had with Millett when she was 14 and he was 18.
However, defense attorney Barbara Gonzales withdrew her motion for a new trial after the victim's testimony, in which she stated several times that she was not coerced as to what she wrote in her statement. She said both in the hearing and in her journal shortly after the incident that she did not want to write a statement or press charges, but said that what she told the police was accurate.
"We weren't sure if that's how she was going to testify," Gonzales said. "I don't think it would change the outcome of the trial after hearing testimony today."
She filed the motion after several pages from the girl's journal got to the courts; the girl wrote that she felt the police pressured her to write down her story and that she wanted to explain to them that she didn't want to press charges, but she didn't feel like they were concerned about that. The LDS bishop of both Millett and the girl also wrote two letters to the court, at least one of which expressed some disconnect between what the girl told her bishop and what she wrote in her statement.
However, after much debate about what sections of the journal would be allowed and stipulations from both sides that the bishop's letters were not admissible, the victim got on the stand and repeatedly said that although she didn't want to go to police and that she didn't like working with them, her statement is factual.
After both lawyers asked their questions, 4th District Judge Claudia Laycock asked the girl to reread her statement completely.
"Now that you've had the chance to look at it again, is there anything else that you would change?" Laycock asked.
"As far as the facts go, as far as what happened, it's all correct," the girl responded.
Millett was found guilty of attempted rape and forcible sodomy in April in regards to his relationship with the then-14-year-old girl, who was his neighbor. He pleaded guilty in July to kidnapping and forcible sexual abuse, both second-degree felonies, in a separate incident; according to a police affidavit he and some friends tried to convince a 16-year-old girl to strip for them, and when she refused they held her down and removed her clothing.
Millett will be sentenced for both cases at 8 a.m. on Nov. 8.

More likely, lurkers will look at the obnoxiousness of what I responded to and think “wow that PD has a lot more self-control than I do, his humorous response is much nicer than what I would have said”.

You may belittle or look down on people you perceive as inferior. You may have a sense of entitlement. And when you don’t receive the special treatment to which you feel entitled, you may become very impatient or angry. You may insist on having “the best” of everything — the best car, athletic club, medical care or social circles, for instance.
