The Illegal Alien Amnesty of Senator John Cornyn (R-Texas) - S.1387 - full text

In July of this year, Senator John Cornyn (R-Texas) introduced his Border Security and Immigration Reform Act of 2003 (full text below), for the purpose of establishing new regulations on foreign-born "guest workers" in the Untied States.

Several sections of Cornyn's legislation warrant a bit of scrutiny...

SEC. 218A. GUEST WORKER PROGRAMS.

(i) ABSOLUTION FOR PAST ILLEGAL BEHAVIOR- An alien who participates in a guest worker program shall be absolved of all liability for illegal behavior, as such behavior pertains to the immigration status of the alien, that occurred before the alien's participation in the guest worker program.

SEC. 218B. EMPLOYER APPLICATIONS FOR GUEST WORKERS.

(f) ABSOLUTION FOR PAST ILLEGAL BEHAVIOR- An employer who participates in a guest worker program shall be absolved of all liability for illegal behavior, as such behavior pertains to the immigration status of employees, that occurred before the employer's participation in the guest worker program.

"Absolved of all liability for illegal behavior" = Amnesty.

Senator Cornyn's Border Security and Immigration Reform Act of 2003 is, among other things, an Amnesty for Illegal Aliens and their employers.

Now, note the following...

Sec. 218A.(c)(2):

EXCEPTION- Notwithstanding paragraph (1), an alien may apply for admission to the United States under section 101(a)(15)(W) without regard to any previous period of unlawful presence in the United States if the alien applies for such admission not later than 1 year after the date of enactment of the Border Security and Immigration Reform Act of 2003.

Also...

Sec. 218A.(f) UNDOCUMENTED GUEST WORKERS- An alien employed in the United States on the date of enactment of the Border Security and Immigration Reform Act of 2003 who does not have proper documentation of authorization to enter the United States shall be required to show evidence that the alien--

(1) was in the United States on the date of enactment of the Border Security and Immigration Reform Act of 2003; and

(2) is employed on the date on which the guest worker registers to participate in the guest worker program.

This means that Illegals crossing the border between now and President Bush's signing of Cornyn's bill (assuming it passes as written) would be eligible for Cornyn's Amnesty, so long as they get a job within the following year.

Cornyn spoke recently about the prospects for his legislation...

There are no scheduled hearings this year, but Cornyn is confident that the Senate Judiciary Committee’s Immigration and Border Security subcommittee - of which he is a member - will address the Border Security and Immigration Reform Act next year.

"In the very near future, it will move from the back burner to the front burner," Cornyn said, adding that the legislation would take at least two years to enact.

Cornyn also said he expects White House support for his proposal, adding that his staff is meeting with the President's staff to discuss details.

Cornyn, it should be noted, has a good relationship with the President, having served as Texas Attorney General under then-Governor Bush in 1999 and 2000. During Cornyn's 2002 Senatorial campaign, he was joined in fundraisers by the appearances of President Bush, First Lady Laura Bush, and also President George H.W. Bush.

If, as Cornyn expects, S.1387 is not enacted for another two years, and since no hearings are scheduled for this year, that means that Illegal Aliens entering the country as late as 2006 would be eligible for this Amnesty program, in addtion to the estimated eight to eleven million Illegals who are already here.

Is this what America wants?

A BILL

To amend the Immigration and Nationality Act to authorize the establishment of guest worker programs, to provide for the adjustment of status of certain aliens unlawfully present in the United States to the status of a nonimmigrant guest worker, and for other purposes.

SECTION 1. SHORT TITLE; TABLE OF CONTENTS.

TITLE I--AUTHORIZATION FOR ESTABLISHMENT OF GUEST WORKER PROGRAMS

TITLE II--ADJUSTMENT OF STATUS OF CERTAIN UNLAWFULLY PRESENT ALIENS TO NONIMMMIGRANT GUEST WORKER STATUS

SEC. 2. DEFINITIONS.

TITLE I--AUTHORIZATION FOR ESTABLISHMENT OF GUEST WORKER PROGRAMS

SEC. 101. GUEST WORKER PROGRAMS.

`SEC. 218A. GUEST WORKER PROGRAMS.

SEC. 102. EMPLOYER APPLICATIONS AND PETITIONS FOR GUEST WORKERS.

Secretary of Labor an application as described in subsection (a). Such certification shall be provided within 14 days of the filing of the application.

SEC. 103. NEW NONIMMIGRANT GUEST WORKER CATEGORIES.

to the United States as a seasonal guest worker under section 218A, and with respect to whom the Secretary of Labor determines and certifies to the Secretary of Homeland Security that the intending employer has filed with the Secretary of Labor an application under section 218B(b); or

Thanks for the additional post. It does clarify my confusion somewhat.

However, upon reading the Cornyn amnesty I got confused again.

Does this mean illegal aliens from Mexico will be excluded? Mexico never has and never will pay one d--n dime for the health care of their citizens.

Can Texas freepers PLEASE explain why the heck this dull establishment candidate and his liberal stance on immigration won the primary?

That was the quietest "open seat" primary I have EVER seen. Cornyn didn't even bother to campaign, was about as exciting as oatmeal, and STILL got like 80% of the primary vote. He was running for the Senate the reason Jim Ryan ran for Governor here in Illinois-- he was the Attoneny General so the party leaders asked him to because of his name reconition. He was the "default" nominee. Did TX freepers even BOTHER to vote in the primary? If you guys had, you should have considered a real conservative like Doug Deffenbaugh.

Agreed. But what this is really all about is the propping up our neighbor to the South and their bankrupt economy. Presidente Fox has freely admitted that Mexico's primary and major source on income is the U.S. dollars flowing back across the border from its Mexican citizens working and living in the U.S. of A.

The current Administration can't / won't allow the Mexican economy to collapse so you have all of these Constitutionally defying bills pouring out of Republican controlled Washington and it will only get worse from the American citizens viewpoint. This is one of the results of the "Compassionate Conservatism" that we voted for.

Hatch is also sponsoring a Constitutional Amendment that would allow naturalized citizens, including Amnestied Illegals, to hold the office of President of the United States

Time for some Republican recalls? Here is the way things are set up in Texas to the best of my knowledge.

When a candidate wishes to be funded by the Texas Rebublican Party, he must read the Texas platform, agree to it, an attach his signature to each page, swearing to uphold that platform, before any funds or support is forthcoming.

Both Bush and Cornyn have violated their contract with the Texas Republican Party. It's time to get jiggy about that. I plan to call Cornyn's office tomorrow and remind him of what he signed onto and ask if he doesn't consider his actions subject to recall and or lawsuit for the return of the funds he received from the Texas Republican Party.

These bozos take an OATH to protect, defend and bear true faith and allegiance to the Constitution.

Sponsoring a Bill that is in DIRECT opposition to the Constitution represents a willful breaking of that oath IMHO.

Hatch should be impeached if this is true, ASAP.

Sure, the Texas Republican Party Platform, is the most conservative document you will ever read. It calls for our removal from NAFTA, GATT, and the U.N. It calls for the retaking of the Panama Canal even.

It calls for increased border patrol, no drivers liscense's for illegals, and I believe no amnesties. A candiate is given a copy of the Party Platform, he must read it, initial each page, and then sign a document agreeing to uphold all the principles outlined and make them his earnest agenda, before any money or support is forthcoming. It is a legally binding contract with the people of Texas, and it is being broken.

About twelve years ago a group of senior citizens chased Congressman Dan Rostenkowski chairman of the House Ways and Means Committee through the streets of Chicago.

As it turned out Rostenkowski was a crook. Maybe what we need is a full accounting of all the Senators and where their money is coming from. There has to be a motive for wanting to sell the American people out this bad...

The reasoning behind the native born requirement was to prevent any foreign power from dominating the USA by installing a President. We should not mess with this provision.

Senator Cornyn obviously is trying to repay the businesses that funded his campaign for Senator last year....by helping provide them cheap labor.

I hope illegal aliens invade his Texas neighborhood....throwing their dirty diapers in his driveway.
