Federal judge says Terri Schiavo must die Rejects plea by parents to allow disabled woman to live

A federal judge in Tampa, Fla., has ruled against Terri Schiavo, the 39-year-old brain-disabled woman, whose death by court-ordered starvation is scheduled to begin in four days. The ruling clears the way for her husband, Michael Schiavo, to remove the feeding tube his wife depends upon for food and hydration.

At the end of a three-and-a-half-hour hearing this afternoon, U.S. District Judge Richard A. Lazzara rejected a plea by Terri's parents, Robert and Mary Schindler of Gulf Port, Fla., to assume federal jurisdiction over the case, refusing to acknowledge that her constitutional rights, in particular her 14th Amendment right to due process, had been violated.

He also rejected a request by the Schindlers for a temporary injunction on removing Terri's feeding tube, until she has received sufficient therapy and training to enable her to be spoon-fed.

He granted a motion to dismiss the Schindlers' petition made Monday by Schiavo's attorney George Mr. Felos, a well-known "right-to-die" advocate.

The case was argued in court by Christopher Ferrara, of the American Catholic Lawyers Association, co-counsel with Patricia Anderson representing the Schindlers and Terri herself.

Pamela Hennessy, volunteer spokesperson for the Schindler family, attended the hearing and pulled no punches in comments to WorldNetDaily.

"I sat there in the courtroom, and it seemed that he cut off every other sentence Chris made. He interrupted him endlessly. I don't think [Lazzara] let him finish too many sentences. I don't think Chris was really heard."

Not even the fact that the Florida Gov. Jeb Bush had stepped into the fight for Terri earlier this week by filing a friend-of-the-court brief on her behalf impressed the judge, said Hennessy.

"[Lazzara] didn't care," she said. "He said the governor's brief was well-written and he allowed him to be admitted as a friend of the court, but he said that [Bush] was only a friend of the court and had no power to intervene."

Hennessey took umbrage at the notion that as a federal judge he cannot take jurisdiction.

"Of course he can," she exclaimed. "[Terri's] constitutional rights have been denied. He could have stepped in, but nope – he washed his hands of it, he didn't want to get involved at all."

As WorldNetDaily reported, the Schindlers have been fighting with their son-in-law Michael Schiavo for 10 years over the lack of care and therapy Schiavo has provided for their daughter, who suffered massive brain damage when, at the age of 26, she collapsed at her home 13 years ago under mysterious circumstances.

The contentious family dispute escalated into a major euthanasia battle in 1998 when Schiavo petitioned the Florida courts for permission to end his wife's life by disconnecting her feeding tube, insisting she is in a "persistent vegetative state" and that in casual conversations she had told him she would not want to be kept alive "artificially." Although Terri breathes on her on and maintains her own blood pressure, she requires a simple tube into her abdomen to her stomach for nourishment and hydration.

Although Terri's parents and siblings have claimed for years that she recognizes them and tries to talk – and over a dozen prominent doctors and therapists have stated under oath that she is not in a persistent vegetative state and with therapy could be rehabilitated – a handful of doctors have testified she is "vegetative." They claim her expressions and vocalizations are simply reflex actions and that she will never regain consciousness. Despite a scarcity of expert testimony and evidence for Schiavo's position, Greer and Florida's appellate courts have consistently sided with him and Felos, his attorney.

When the seven-member Florida Supreme Court washed its hands of the matter in August by turning down an appeal by the Schindlers to review the case, the way was clear for Schiavo to starve his wife to death.

On Sept. 17, probate Judge George Greer, of the Pinellas-Pasco Circuit Court, scheduled Oct. 15 as the day Terri's feeding tube would be removed.

At the same time but in separate rulings, Greer – who has been in charge of the case from almost the beginning – denied any rehabilitation whatsoever for the disabled woman. An Aug. 26 request by the Schindlers asking that their daughter be allowed an eight-week trial of speech, occupational and physical therapy, was summarily rejected by Greer along with a motion made Sept. 10 that she be taught to swallow food so she could be spoon-fed.

With the state courts closed against them, the Schindlers sued their son-in-law in federal court to block the scheduled Oct. 15 removal of their daughter's feeding tube. In their Sept. 22 request for a preliminary injunction, they asked Judge Lazzara that Terri be given therapy for a sufficient time to wean her off her feeding tube and return her to nutrition by mouth.

Today's ruling by Lazzara has destroyed that opportunity and the hopes of Terri's family and supporters that she would be allowed to live.

Terri's feeding tube is scheduled to be removed at 2 p.m. Wednesday. Physicians say her slow death by starvation and dehydration will take anywhere from seven to 14 days.

The Schindlers and their attorneys were unavailable for comment.

I clicked "reply" with the intentions of saying something, but, I do not believe that I can add anything to what has already been said.

With this Judge's refusal to intervein, we are one step closer in this Nation to the government ordered killing of all cripples, mentally handicapped,people who have birth defects,or contract any other affliction.

However, there is one fact that one can take to the bank:
If Terry was a cold blooded murderer awaiting to be put to death, this Judge would have not hesitated to prolong her life.

This is cold blooded in the first degree. Nothing less.

Actually, I don't ascribe bribes taken, to judge Greer. His is a more complex malady that results in very poor rulings from a very important bench.

It is more likely that Greer is seeking to cover up his own grossly flawed rulings ... like granting guardianship to Michael but not holding the guardian to the requirements of reporting, like secretly granting the raiding of Terri's rehabilitation funds to pay Greer's business associate Felos, like shifting the blame for Terri's execution to Federal rulings when it is Greer who made the inititial ruling and has repeated that mistake without reviewing the facts in the case, like denying Terri's basic human rights to therapy to see if she can learn to swallow and get off of the feeding tube, like allowing the starvation of stimuli to Terri under the guise of 'she can't experience anything anyway', like appointing a person recommended to the court by Michael's atty, Felos, to judge what Terri's level of awareness is when it is the Felos mantra to execute Terri, like ... well, you get the picture.

Greer is more likely incompetent and remains on the bench without judicial review, making death decisions that can cover his feckless butt, because of the failure of the Governor's office to take oversight action and the overly liberal higher court judges in Florida, put there over years of sickening liberal rule in Florida.

Did you know that your state of SC was larger than FL in 1940? I guess 63 years hasn't improved things as much in FL as we might have thought. What a sick state! Look how you all revered the elderly Senator Thurmond in contrast to how FL treats its most vulnerable. Give me SC over FL any day!

What I find so objectionable is that the system doesn't grant the benefit of the doubt to this woman who is scheduled to be killed.

Bingo.

Erring on the side of caution regarding human life should ALWAYS be the deciding criteria.

I cannot find reason to feel the outrage that you seem to feel. Concern, yes. outrage, no.

I think it's because people tend to put themselves in the other's shoes. If it were *your* daughter -- you'd be outraged that the courts were ignoring your pleas and the value of your daughter's life.

I am concerned and downright frightened that the line is going to be blurred further and further as to who is worth keeping alive, and who just just be rubbed out to save us the effort of keeping them alive. Yet we throw TONS of cash at people who are perfectly ABLE to work and produce, and don't do it. What an Alice in Wonderland we live in.

This is the first I've heard of this story. From that perspective, let me say this: Once a person is married, they no longer belong to their parents, but to their spouse. This is, therefore, her husbands decision.

Second thing: If she is "brain dead" and being kept alive artificially, It is not killing, it is letting the body do what is inevitable. The only reasons for keeping such a person alive are 1) They are waiting for a non-pie-in-the-sky procedure to be done to bring them "back to life"; or 2) Their loved ones want to keep the umpty husk of a biological machine alive for old times sake.

The answer in the former case is to pray for them and then pull the plug. If God wants to use this particular case to prove His power or make some other point that needs making to anyone that witnesses the event, she will recover.

The answer in the latter case is that a case could be made that she is a pawn of those that just want her around, like a big breathing teddy bear, with matching brain function. That is a very selfish position. Of course some of them hope against hope that MAN will find a solution. Maybe they should look at the God solution, which is significantly more plausible - AND real.

If there were no money involved, the hubby would not be seen as such a monster.

And yes, we have personal experience with this kind of situation.

There is not even the SLIGHTEST doubt in my mind that Terri is VERY ALERT and conscious. She just needs therapy to help her use her voice again. Look at her eyes and you will see there isn't a vegetative or comotose bone in her body!!!!!!

yes, VERY sleazy!!! Unreal and horrifying!! We have a 25 year old severely handicapped son.He " talks" mostly with HIS EYES. We have learned over the years to " KNOW" what he is saying through looks. TERRI SCHIAVO is VERY ALERT. I am PRAYING FOR THE GOVERNOR to TAKE ACTION TODAY......TODAY.........TODAY!!!!!

I'm still very curious about how she came to be in this state. Her website doesn't really cover that.

Same here. Does anyone have a link to a site that explains what happened to her originally, and why she was awarded money by the courts?

She's not. She's awake and conscious and interactive even. I felt ambivalent until I saw video. She just cannot communicate supposedly. Her eyes are open, she grasps hands, etc.
