Ask any doctor what a "rescue inhaler" is and they'll repond "albuterol inhaler." Anyone with moderate to severe asthma will carry one with them. They are bulky and sometimes you will forget. Believe me, you will seek out a buddy when you need one and can't find your own.

As much as I have lawsuits, I think this is time to sue the school district and the nurse. Asthma is common enough that any school will have a few asthmatic students. Why didn't they have a rescue inhaler available? If she was having an attack, why didn't the nurse call an ambulance? An attack can be a life-threatening event. How did the nurse make her "diagnosis?" Did she use a pulse-ox device? Did she use a breath meter to determine the amount of airflow?

Sue them and chances are, they will back down.

This kid now has a drug arrest on his record.

No matter what the outcome, his permanent file will show that he is a drug criminal.

For the rest of his life, every school he attends and every employer will know him as a drug criminal.

Sounds like a police state to me.

It will end when people are once again convinced that they CAN handle situations with common sense without having to resort to sending a fax to Washington to get advice/permission, i.e. when liberalisn is defeated once and for all.

What ever is not obligatory is forbidden. What is not forbidden is obligatory.

Why we continue to put our kids in the hands of these people, I do not know. Local control of the public schools, and a private alternative to them must be job one. What kind of education can they be getting at the hands of morons?

But the school nurse said it was a violation of the district's no-tolerance drug policy, and reported Kivi to the campus police.

I wonder if, with a big enough club, it's possible to beat "DON'T BE A MORON" into that school nurse?

This chit makes me mad enough to spit.

Zero tolerance maens zero brains, zero common sense, and means zero to me.
I would sue the blood out of every school employee involved including the school board.

If the school officials made any effort to prevent the kid from loaning the inhaler to the girl, the parents should insist that they be charged with attempted murder.

Every school nurse should know the first thing you do when someone's having an asthma attack and no medication is to call for an ambulance, not try and wait it out. Minor asthma attacks can escalate in a very short time. I know.

I used to have asthma. Took an advil, not knowing I was allergic and within a half hour my breathing was mildly labored. Took my medicine, nothing to worry about. Five minutes later I was in the middle of the worst attack I've ever had. My sister said I turned blue. Thank God she was too terrified to drive me to the emergency herself and called an ambulance instead. Even the ambulance guys were scared.

At the very least, these parents should call for that nurse to be replaced with someone more competent. What parent is going to want a school nurse who is willing to let their child suffer, rather than break a rule?

If I was the president or governor, I'd issue a pardon.

BTW. I'm an asthmatic myself, have an inhalor(Proventil or Albuterol), and have probably broken the law myself lending it to a friend who had an attack after a track run.

Luckily, no jackass reported me to the cops.

The school officials have spoken! All hail the wise and beneficent school officials! We must accept the wisdom of the school board. I suspect that soon the Caney Creek High School will be changing it's moto to "IGNORANCE IS STRENGTH!"

On Friday, school officials decided to expel Kivi but not press criminal charges. They said it was an amicable agreement.

"I'm happy. Everything's final," Kivi said. "I'm expelled 'til after Christmas and I can come back after Christmas, but I won't."

...

Both Kivi and Ferguson decided to withdraw from Caney Creek High School to be home-schooled.

The girl had trouble breathing. Inhalers are used *to avoid* a life-threatening situation, which in severe attacks can be less than thirty minutes. By the time an asthmatic is in a life-threatening situation, an inhaler would not be effective because the bronchospasm is too severe to allow inhalation of the medication.

Fire the nurse and hire the kids. Jeez...
