Recall of Arnold--let's hash this out here

There's been discussion tonight of whether or not Dems can launch a recall against Arnold as soon as he takes office. Some have said they can't; some say they can. Fox news just said that the dems have $3 million on the table right now to launch a recall. For those who said that they must wait 6 months (including me), that is apparently NOT true. That appliwes to a sitting Gov who survives an initial recall attempt. They COULD launch one immediately, however, all pundits say it would be very, VERY unwise to even attempt it.
Just trying to clarify for everyone.

I can't believe even Democrats are this stupid. Why the hell would they try to recall Arnold so soon? Like, do they really think Davis would have won today if he had run a better campaign? What's going to change between today and next February?

Clearly you would have to wait.
Also. Davis got recalled in a second not a first term.
So by the time Arnold gotten things going and
people are ready to make a clear judgement on him
it probably be late enough in this term that
a recall would unlikely because people will
say wait until the next election.
So another recall unlikely regardless of how
things go.
And if Arnold really go badly Democrats will
want to wait to gain maxim damage to Republican
party etc..
So just some silly talk not going to happen.

I can't believe even Democrats are this stupidI can't believe they would be. The solid middle in California, the middle that turned on Davis this year, would give any new governor, even Cruz Bustamante, a chance to govern.
But given the way the Bush-hatred-drooling Democratic leadership operates, some of them will think it's a bright tit-for-tat move. Let 'em try; they'll lose huge.

What are these rats smoking....Arnie and Tom get 60% or so ......this is a GOP ticket...
First off....who is going to be on the ticket.
Second...this will impact into the '04 race....I am sure Miz Shrillary will be just sooooo pleased to have all that ATTENTION and dem MONEY spent in a CA recall.
Finally...this is such a severe repudiation of the rats that they will have to make a strategic withdrawal and re-configure their approach.
What they are pushing IS A LOOSING ISSUE.....don't hold your breath....
I guess the rats will morph into lemmings and jump of the cliff into oblivion.....(excellent smithers)

Someone on one of the news channels pointed out that because the turnout of this election is so much larger than the last, the number of signatures needed to qualify another recall is significantly higher. In any case, I don't think they would succeed. Just tough words on a night when they will have tears on their pillows.

On your premise however: California Election Code 11007 says,
Except when a person has been appointed to office pursuant to Section 10229 because no person had been nominated to office, proceedings may not be commenced against an officer of a city, county, special district, school district, community college district, or county board of education in the event of one or more of any of the following:
(a) He or she has not held office during his current term for more than 90 days.
(b) A recall election has been determined in his or her favor within the last six months.
(c) His or her term of office ends within six months or less.
You might be able to argue that a winning candidate like Schwarzenegger falls under (b) , having a recall "determined in his or her "favor, and (a) would certainly seem to apply, so he'd have at least 90 days or possibly 6 months.

If I am not mistaken..this 92 year old recall mechanism has been tried for virtually every governor since it was created..davis is the first one to ever have it work..which is so surprising..he is such a nice guy..(sarcasm off)..
