Alleged Audio Tape of Rush and Drug Dealer Maid Could Not Be Used In Court. Maid Committed Felony Recording It!
The woman who claims she recorded Rush Limbaugh asking her to procure drugs for him could be in some big legal trouble, and the recording she claims to have could not be used in court.
Florida has very strict laws against the interception of communications. (see http://www.flsenate.gov/Statutes/index.cfm?App_mode=Display_Index&Title_Request=XLVII#TitleXLVII) These laws are extensions of the older anti-wiretap statutes, but go much further than the old laws did. The expressly prohibit the interception or recording of any communication, oral, electronic, etc., without the active consent of all parties to the communication, on in this case, all involved in the communication.
This law reaches far beyond traditional wiretap concerns, such as the telephone. For example, television news reporters in Florida cannot use any hidden microphones in investigative stories. After a recent Central Florida union negotiation, city officials were ready to press charges against union members who tape-recorded the meeting without notifying everyone involved. Telephones or radios do not have to be involved for this law to be in effect. Any interception, recording, etc. of any type of spoken communication is a big no-no!
The law is so strict; it even prohibits the possession of devices designed for the unauthorized interception of oral communication, so forget about getting one of those CIA martinis with the microphone hidden in the olive! :~)
There are exceptions for law enforcement officers acting under court orders, but that certainly does not cover a maid who claims she made the recording before she went to the cops!
Not only can the maid be charged with a felony for recording her conversation with Rush, but the law specifically prohibits any recording illegally made from being used in any court, legal or regulatory proceeding.
So there is much more to come out in this case, so it will be on the front burner for weeks and months. Some of the maids claims are patently ridiculous, such as Rush using an average of 93 pills such as Oxycontin every day for more than four months. Try doing a high-involvement radio show, with call-in guests, on one Oxycontin, and watch the ratings drop like Clintons pants. Personally, I think its a blackmail attempt that went bad, but we shall see.

Thank you. Was hoping I was not the only one here to be suspect of the "90 pills a day." Even Elvis (the later years) did not do that many. This whole thing smells of Terry McAwful/Hildebeast, etal. And yes, I listen to RUSH daily and have for years. But some of these claims are pure horse-hockey. Show me someone who took 90 pills and I'll show you a corpse...

If Rush is not innocent, I wish he'd be a man about it and confess on air, let the chips fall where they may, appologize, seek help and beat it in public.
Most people have relatives who have had some sort of problem. They still love them. Rush has been an inspiration to me and I expect he will be in the future.
He can beat this if he has a problem.
