Judge blocks part of Calif. state budget borrowing plan

SACRAMENTO (AP) - A judge has blocked as unconstitutional the state's plan to borrow nearly $2 billion to pay for employee pensions, part of the more than $15 billion in borrowing lawmakers relied on to balance the budget.

If upheld on appeal, the judge's preliminary opinion could raise legal questions over other planned bond sales in the $99 billion budget signed by the governor early last month, and possibly lead to further cutbacks and new taxes.

The Howard Jarvis Taxpayers Association, which filed the lawsuit challenging the borrowing, called the judge's decision "a significant victory for taxpayers."

HJTA has endorsed Arnold, of course!

I believe it's against the state constitution to borrow money for the current year's expenditures without a vote from the electorate, and that's exactly what the fools did.

"Other groups are considering lawsuits to block the sale of more than $10 billion in deficit bonds because Californians did not vote on the bonds, as required by the state Constitution."
