Legal scholars see Oct. 7 Calif. recall election
USA Today ^ | 9/21/03 | Martin Kasindorf,
Posted on 09/22/2003 12:25 AM PDT by kattracks
LOS ANGELES The 11-judge federal appeals panel that hears arguments today over California's recall election is likely to restore the Oct. 7 date that a three-judge court postponed, legal analysts say.
And legal scholars who watch the 9th U.S. Circuit Court of Appeals say the politically charged case probably will never reach the U.S. Supreme Court.
The full circuit court on Friday sent the case to 11 judges for reconsideration today in a televised hearing in San Francisco. Analysts say the expanded panel will overturn last week's 3-0 ruling delaying the election, probably to March. The observers emphasize two indicators: ....

Despite some improvement in polls, governor still faces uphill battle in recall

http://sfgate.com/cgi-bin/article.cgi?f=/c/a/2003/09/21/BA209426.DTL With barely two weeks to go until Oct. 7, Republican and Democratic tracking polls show the California recall is still an uphill battle for Gov. Gray Davis -- and a big question mark for everyone else.
The polls show that even with Davis winning help from Bill Clinton, Jesse Jackson and Dianne Feinstein -- and after having held a string of connect-with- the-people town hall meetings -- anywhere from 51 percent to 56 percent of voters are still ready to dump him. Just 41 percent to 44 percent want to give him a second chance.
That's an improvement for Davis from over the summer, when support for the recall was at 57 percent -- but it still means he must close a 10-point gap to keep his job.
"I've never seen anything like it in my life," said one Democratic pollster who has been tracking voters since the recall got rolling.
"It's just sitting there -- 53 percent for recall, 43 opposed -- week after week," the pollster said....

DAVIS' SOP TO TERRORISTS: GROUNDS ENOUGH FOR RECALL
NY POST ^ | September 22, 2003 | LETTERS COLUMN
Posted on 09/22/2003 3:23 AM PDT by Liz
I read Rich Lowry's column ("Terror Made Easy," Opinion, Sept. 13) and realized why this country has a sign on its back that reads kick me. Where is homeland security? Why can't California revoke the rights of illegals to get driving licenses? Instead of taking strong steps to abort this type of asinine policy, Tom Ridge states that states enact such a policy "at their peril." Wrong. They do so at our peril. Illegals should not be given any such right, and this type of political correctness or political pandering should never even be suggested, let alone passed into law. Paul Alexander Staten Island ....

The real Schwarzenegger would like to stand up (Arnold melts Maureen Dowds cold cold heart)
The New York Times via SMH ^ | September 23, 2003 | Dowdy Mo
Posted on 09/22/2003 6:50 AM PDT by dead
Arnie's popular in California but he's also having trouble being taken seriously as a politician, writes Maureen Dowd.
I picked up the phone. Arnold Schwarzenegger's Teutonic accent boomed through the line. "Who's your daddy?" he demanded.
I was stunned. I was expecting a call from his campaign office because I had asked him the day before if I could have an interview. But what could he possibly be thinking? Had all the flak he'd been taking from the other candidates about avoiding debates driven the movie star off the deep end? Were those Arnold the Barbarian rumours true?
As I was trying to figure out how to answer, the voice grew more insistent: "Who is your daddy and what does he do?"
"He was a policeman." Arnold barked: "You lack discipline!"....

Tom Cant Win? Wrong Do the Math Silent Switch Makes McClintock Governor
9-22-03
Posted on 09/22/2003 7:28 AM PDT by tallhappy
Real Clear Politics elegantly presents all the polls concerning the California Recall election at this link
It seems that just about everyone pushing Schwarzenegger as the best chance for Republicans also feel McClintock would be preferable if he had a chance to win. McClintock is thought to most reflect their values and positions on issues. But Tom cant win.
A simple perusal of the poll numbers, though, belies this conventional wisdom. Do the math. If only 60% of Schwarzenegger supports decided to vote for McClintock, McClintock take the lead....

How state's business tax burden stacks up - Your taxes: How California compares
Mercury News ^ | 9/22/03 | David A. Sylvester
Posted on 09/22/2003 7:39 AM PDT by NormsRevenge
To listen to the campaign rhetoric, you'd think the candidates weren't asking for the recall of the governor but of the state's economy.
Business lobbying groups have produced new studies claiming the state has grown hostile to business. Pro-business groups have criticized what they call ``job-killer bills.''
Gov. Gray Davis' campaign defends his handling of the economy by pointing out that the entire country has lost jobs at about the same rate as California.
What's the truth?
In fact, California is an expensive place to do business, but the most popular focus for criticism -- taxes -- isn't the biggest problem....

Bustamante, Camejo promise to fight reversing of license law
SFGate.com ^ | 9/22/03 | Mark Simon - SF Chronicle
Posted on 09/22/2003 8:44 AM PDT by NormsRevenge
Two recall replacement candidates racing to tell voters what they stand for were reminded Sunday of the problems that await them should they win the governorship -- the crisis in affordable health care, the scarcity and rising cost of housing, the declining performance of the state's schools and the dispute over providing driver's licenses to undocumented immigrants.
The Green Party's Peter Camejo and Democratic Lt. Gov. Cruz Bustamante were the only two of the major replacement candidates in the recall election to appear at "Who Will Listen to the People," a forum in San Jose sponsored by the Pacific Institute for Community Organization, a statewide network of church-based community organizations that has affiliates in 70 cities and boasts a membership of 450,000 families....

Schwarzenegger's Risky Defense: He Stretched Truth
LA Times ^ | 9/22/03 | Joe Mathews
Posted on 09/22/2003 7:32 AM PDT by NormsRevenge
As potentially embarrassing statements from Arnold Schwarzenegger's past have come to light, his campaign has developed an unusual standard defense: He made it up.
Confronted with Schwarzenegger's own words on drug use, his early business practices, women and his immigration status, campaign aides and the candidate himself have disavowed many of the comments he has made during the last 30 years.
In doing so, they have said that Schwarzenegger either exaggerated or erred in dozens of interviews he gave to promote his career and even in his 1977 autobiography....

"Hydrogen highway" my arse!
Wait until the Greens discover that hydrogen gas is far more destructive of "the ozone" than Freon ever was - and that 15% - 20% of all stored hydrogen leaks out!

A Magic Bullet for the Anti-Schwarzenegger Camp (Option B for McClintock Supporters)
My own thoughts... | 09/22/2003 | DoughtyOne
Posted on 09/22/2003 11:55 AM PDT by DoughtyOne
For about a month now, there has been a tit for tat disagreement here about who to vote for in the 2003 Recall Election. A number of people have supported Tom McClintock's candidacy faithfully here. Just about everyone else stated they would vote for Tom if he was viable, but would vote for Schwarzenegger if Tom couldn't get his numbers up.
This has led to some heated debates, even among friends here. Even if Tom was losing the battle, they thought loyalty to him and his policies trumped everything else. Look, I don't necessarily frown upon that, except where it may facilitate the likes of Cruz Bustamante being elected instead of Tom's opponent....
