That's what I thought. Perhaps the 9th will hear the appeal first as to drag this on, allowing no time to complete the recall election in a timely way?
I'm sure someone has the full scoop...?

The judges voted to hold the
en banc hearing. FWIW, if the 11 judge panel still postpones the recall, this just further constricts the timeframe for intervention by the Supreme Court.
It also gives Justice O'Connor time to get back from Europe and take authority over any appeals, rather than Justice Scalia who would review petitions so long as O'Connor is unavailable.... the full court can review the decision of the three...
they probably didnt like the numbers they saw last night, that 70% of Californians want the recall to go forward, and LA COUNTY saying they can't hold a recall in March.

or it could be a big face slap down to the most liberal, activist court in US history.
Front page article in my paper today talks about how the 9th circuit is the most reversed court in the US.
In the past year for example, the Supreme Court reviewed 10 rulings by the 9th circuit court and reversed ALL OF THEM.
I'm impressed by the speed of this move and hope it's another of many repudiations of this liberal farce of a court.
Let the world see what a laughing stock this court already is.

There is something quite appropriate about O'connor spending her final time in Europe. One usually prefers to find a burial site in which the population will not urinate on and that is as far away from all the landfill's of dead babies as possible. I'm not so sure how any justice still hanging onto abortion is going to reconcile with their maker. Hiding out in Europe does not alter that problem in the end.

They said due to state law, Los Angeles County would have to have two ballots per person, even to comply, since there are so many candidates on the recall, and then so many issues and candidates on the March ballot.
(Plus the Inititative to overturn Illegal Alien license, which although has even started, is expected to make it by March.)

I heard it had to do with the electronic voting gear scheduled to go online in March not being able to accomodate the long list of recall candidates -- it just isn't set up right for 100+ names on the ballot.

Of course now the election will be "a legal mess", "controvercial", "full of legal dilema's" and so on........... Why did they issue any ruling at all? Why not keep your mouth shut and stay smart rather than issue a ruling and remove all doubt of stupidity.
