Federal judge says he may delay California's Oct 7 recall

(San Jose-AP) -- A federal judge in San Jose says he may decide to postpone California's October recall vote.
US District Judge Jeremy Fogel heard from civil rights groups earlier today. They argued that the quick election is forcing changes in the voting process that require federal approval.
Under the federal Voting Rights Act, any changes in the voting process must be pre-cleared by the Justice Department in places like Monterey County that have a history of low voter turnout.
Fogel set a hearing for August 29th. He suggested he may delay the election at that hearing if federal approval hasn't happened by then.
Also today, Fogel ordered Monterey County not to mail out its overseas ballots until the issues are resolved.

Your post is edifying. Wish there were a way to send it out to Sean Hannity and Bill O'Reilly and Rush, etc. It needs to become a talking point for those who are sick and tired of judicial activism and want sanity and the rule of law restored.
This entire debacle, an overt attempt to delay the recall, has the filthy clinton name written all over it....deeply.

he donated.
I want to know with whom he is in cahoots. Someone said he is a Clinton appointee. That makes sense in the larger scheme of things as Clinton is working to save Davis right now.

You could try to look up the judge's pre-confirmation donations at www.opensecrets.org ... but once seated, judges are barred from making most kinds of political contributions.

"Frankly, I'm looking for a hook that's very different from the one I've looked at and been forced to reject," said Fogel. "I would need something new and different other than someone saying: 'Judge, you got it wrong last time.'"
Fogel made his request in a case brought by local government officials and medical-marijuana advocates that seeks an injunction to stop the raids at Wo/Men's Alliance for Medical Marijuana (WAMM).
In September, federal agents seized the cooperative's 2002 marijuana crop. In December, Fogel refused a request by WAMM to force the government to return the seized plants. Fogel said that federal law, which classifies marijuana as an illegal drug, supersedes the state's medical-marijuana law.

Since when is a STATE election in a federal judge's jurisdiction? It seems to me he is exceeding his authority. When the Nevada Supreme court ruled that only a majority vote was needed 'cause it was education or some such nonsense... many FReepers wanted the Federal courts to intervene.

Warren Buffett is an investment Guru. If Buffett tells American CEO's that California is a ripe place for investing in their business (i.e expanding in California not leaving) they are going to at least listen. I'll guarentee you that before the Buffett announcement this week 2/3 of California (oh what the hell 5/6) hadn't even heard of this guy or even Berkshire Hathaway. This selection was targeted at Corporate America not Californians.

Do you suppose this Rat judge would be satisfied if the Justice Dept approved the plans, and announced they would send special teams of US Marshals to observe the election in these 'special' counties to prevent intimidation? coincidentally they would also BOLO for voter fraud :-)

Another thought occurred to me that Warren Buffett will also help solidify California's Bond ratings by giving confidence to those who rate the bonds. If our bond ratings go up then we pay lower interest rates on new bonds issued. That means we'll pay less money each year to the bond holders. This can save California millions in interest payment. I know this is a drop in the bucket, but it is a start and a simple way to start reducing the fiscal disaster. It is a pretty saavy strategy because Scwharzenegger doesn't even have to listen to Buffett on other issues.
