The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

My apologies...Not only skill, just greatest skill. Yes, maybe I do seem to have definite beliefs like everyone else here but then these saturation-level cases can make us all over-react! I'm just tired of him being portrayed as a hero by some. He was drafted into the NBA before his 18th birthday & college and seems to live extravagently but give little back in terms of charity, etc. And I hate to see this young woman automatically trashed. I mean if she hadn't attempted suicide it would be something else they would use against her. It always ends up that way.

I don't know how sexual assault is different from rape.

I'm no lawyer, so technically, I can't specify exactly what the legal difference would be.

As I am sure you know, there is statuatory rape.

Having consentual sex with a partner who is legally underage but was willing.

Assault and battery combined with sex would, to me, imply physical injury to the person.

Another example, is where a female is drugged, and then raped. She would likely suffer no physical injury, didn't have to be held down, so it would just be Rape.

In this case, it is alledged that the female was consenting to normal sex, but that the male in question allegedly wanted deviant sex, and the female didn't.

Also alledged is that she resisted and was physically abused (beaten?). That is SEXUAL ASSAULT and BATTERY.

Thank you for your reply and allowing me an opportunity to explain my understanding of this difficult subject.

All I know is what some posted they heard Drudge say on his radio show---as rumor. Also a freeper who said he was in Italy said they reported that story there.

Zero regular reporting (such as it is) on that aspect.

Way I heard it is the victim did not consent to any penetration-regular sex. It has been suggested she may have consented to oral sex: no media report has ever suggested that though. He may have kissed her or touched her.....who knows?

Wait, I misread the post-I thought you meant vaginal stiches. I did indeed hear the Drudge report. He did report the anal sex story on his radio show. It was posted on his website the next day, and there was a lenghty thread about this subject around that time so there must have been another source. Don't remember what it was though.

I do not go to Drudge daily as I used to, so thanks. I never saw it there or saw his report posted over here.

I wonder if this means one of the bodyguards has a conscious and will provide eyewitness testimony.

That was pretty much a quiet rumor from about day one after he was charged. Even at that time, before all these other stories came out, the rumor was that a bodyguard would testify that she consented to either vaginal intercourse or oral, and then had anal forced upon her.

Accuser attempted suicide twice in past several months
Accuser auditioned for American Idol

Kelly Clarkson auditioned for American Idol too. I never realized that Kelly Clarkson was psychologically unstable, but she did audition for American Idol, so I guess that proves it.

It would not surpise me if the DA has video tape taken from a surveillance camera at the facility that shows the female in a state of panic just after she leave Kobe's room.

The information will come out at the trial. The evidence has been very well documented and there is plenty of proof.

Sexual Assault. This will be the proven charge.

Rape? Since she alledgedly consented, it is hard to prove that.

He may have kissed her or touched her.....who knows?

Oh, he did a little more than just touch her.

As to who knows... Doctors,deputies, staff at the hotel, there are quite a few that can testify as to what they saw. There are photographs, medical records,etc. It will all be part of the trial. Exactly what it will tell, you will see in trial.

But since he thought it out and still chose to go forward, methinks he really felt after sleeping on it that Kobe could be proven guilty beyond a reasonable doubt.

I see what you are saying. He thinks he can prove the case to a jury. I'd like to see some evidence.

His actions do not say slam dunk to me. What was all that business with the sherif? Why deliberate so long?

I want to know what those 911 calls from her house were. If they have any connection to suicide attemps or other accusations, I'm going to have a hard time believing her story.

They probably aren't good for the DA. He doesn't seem to want the public to see them.
